Based upon the test-taker's ability to answer this and subsequent ques- tions, the computer generates a test of varying levels of difficulty. The score is based upon the number and diffi- culty of the correctly answered ques- tions. Test takers are able to receive their scores much sooner than the normal four-to-six week wait. Ann Mecca, Kaplan spokeswoman, said ETS is using the lawsuit as a diversion from the more important is- sue of test security. "We want to make sure the test is fair," Mecca said. Ray Nicosia, a spokesman for ETS, denied that there is a problem with the computerized testing system. He said he feels that students have always come up with ways to get better scores on exams and he added that memorizing test questions is nothing new. He noted that students sometimes stay home from school on the day of an exam and take it the next day after speaking to classmiates. ETS doesn't believe that Kaplan made any discovery about the security of the exam, he said. "We (ETS) have successfully sued students and coach- ing firms in the past for copyright in- fringement," Nicosia said. Before taking the exam, the test taker agrees not to share the questions in the exam with anyone. Princeton Review decided to enter the suit on behalf of Kaplan, though officials said they feel that Kaplan was not completely justified by their actions. John Katzman, founder and presi- dent ofPrinceton Review, said his com- pany raised the limited question pool problem to ETS in the fall of 1993. Katzman asserted Kaplan "pushed the issue at the moment it would incon- venience the most number ofstudents." "They're (Kaplan) wrong, but ETS is wronger," Katzman said. Mike Reilly, director of graduate programs in Michigan for Princeton Review, expressed concerns about the apparent breach of security. It shows they're unprepared for their own tech- nology... theoretically, you could have five or six friends go in the day before you and record the test," he said. Between 400,000 and 500,000 stu- dents take the test annually and about 100,000 students were expected to take the computerized version this year.
