Jim Leach of Iowa, President Clinton's leading Republican critic in the Whitewater controversy, charged yes- terday that the Arkansas real estate venture ultimately was used "to skim, directly or indirectly, federally in- sured deposits" from a Little Rock savings and loan. Presenting what he called the find- ings of a months-long investigation by Republicans in Congress, Leach released more than 100 pages of docu- ments that he said prove Clinton and his associates guilty of benefiting fi- nancially and politically from Whitewater, stonewalling on the sub- sequent investigations and interfer- ing with federal regulators. "Whitewater may have begun as a legitimate real estate venture," Leach said, but eventually "it came to be used to skim, directly or indirectly, federally insured deposits" from both Madison Guaranty Savings & Loan and Capital Management Services Inc., a Small Business Administra- tion-backed fund that made govern- ment-subsidized loans to what were supposed to be economically disad- vantaged borrowers. Included in the documents was a memorandum in which a senior fed- eral investigator of the Whitewater controversy concluded that the real estate investment shared by Clinton, first lady Hillary Rodham Clinton and two friends cost the federally insured Little Rock thrift more than $100,000. This is the first government estimate of the financial impact of Whitewater on Madison Guaranty, which eventu- ally folded at a cost to taxpayers of more than $47 million. The documents Leach released, many of them internal memoranda and notes written by federal regula- tors and investigators working for the Resolution Trust Corp., provided no evidence directly linking Clinton or his wife to that scheme. But the mate- rial provided new details about many aspects of the controversial case, in- cluding a conclusion by investigators that Clinton's Whitewater partners had used Madison and its subsidiary in a giant check-kiting scheme. to reach the top? He disavowed any knowledge of the land venture's management, which he said was handled by his business partner James B. McDougal. He de- clared he had no knowledge of any money from McDougal's Madison Guaranty Savings & Loan flowing into either his Arkansaspolitical cam- paigns or the Whitewater business accounts - two of the chief allega- tions in the matter. In the one new detail added to his account of the affair, Clinton revised downward his estimate of the amount of money he lost in the venture to build vacation homes in the Ozarks. He said he now believes that he lost roughly $22,000 less than the $68,900 he has claimed for the past two years. Saying he could shed no light on the continuing reports of abuses and deceptions, he said, "We didn't keep the books or records. We were essen- tially passive investors," Clinton said. He said that when history judges this affair it will shrink to insignifi- cance next to what he has accom- plished in his first year in office. The president looked at ease and smiled frequently, radiating an ap- pearance intended to demonstrate his avowed confidence that the allega- tions will be shown to be baseless. He also tried to forcefully deny allegations, raised again yesterday by Rep. Jim Leach (R-Iowa) that the ad- ministration tried to keep federal offi- cials from moving toward a criminal investigation of the savings and loan. "I have had absolutely nothing to do, and would have nothing to do with any attempt to influence an RTC regu- latory matter," Clinton said. Leach, ranking Republican on the House Banking Committee, released documents showing that an Resolution Trust Corp. official had met with a regional investigator in Kansas City on whether Whitewater could be found blameless in Madison Guaranty's losses. Clinton said Leach had not made accusations about any political ap- pointee of the administration, and as- serted that Leach "may be talking about an internal dispute within the RTC from career Republican appoin- tees, for all I know." He said the people involved were in government before his Democratic administration arrived. Although Clinton offered that he overstated his earlier estimate of his losses from Whitewater, he said he did not think he would be found liable for additional federal income taxes. But he said that if it is determined that he has a tax liability, he will pay it. The lower figure for losses widens gap between what Clinton invested and lost in Whitewater and what his supposedly equal partners, James and Susan McDougal, lost.
