Although Fiske pleaded with con- gressional leaders Monday not to hold Whitewater legislative hearings be- cause they could compromise his in- vestigation, aides to House Banking Committee chair Henry Gonzalez (D- Texas) said there was no legal way to avoid giving Leach the demanded fo- rum on Whitewater. Cutler said he had recommended that requested White House witnesses go to Capitol Hill for the hearing. Clinton, while again complaining that Republicans were seeking partisan gains and should let Fiske work unim- peded, said he was "fully in accord" with Cutler's recommendation. Clinton also said it was "hard for me to imagine a case" in which he would invoke executive privilege, a fuzzy legal doctrine unsuccessfully used by former President Nixon during the Watergate scandal, to prevent Fiske from obtaining executive- branch documents or testimony. Congressional Republicans continued to demand additional inquiries into the Clintons' investments. Sen. Alfonse M. D'Amato (R- N.Y.) ranking minority member of the Senate Banking Committee, took to the Senate floor to suggest that Hillary Clinton owed the nation an- swers to questions about Whitewater. Minority Leader Robert J. Dole (R- Kan.) threatened to force a Senate vote on whether to hold hearings into Whitewater and the Madison S&L, which was owned by the Clintons' partner in the Whitewater investment. Special counsel Robert B. Fiske has warned lawmakers that hearings could jeopardize his investigation. Clinton noted that yesterday but said that his "inclination would be to obvi- ously participate" if the hearings go forward, and Cutler said that he would recommend that White House staff called to testify "cooperate." Clinton stressed ethics in his pre- pared statement on Cutler's selection, saying he wanted an "eminent lawyer who could step into the role immedi- ately and bring to thejobthe stature, the standards and the experience that the American people expect." Cutler said that during the 130 days he has agreed to work at the White House he would concentrate on instituting "the procedures and the actions necessary to maintain public confidence in the integrity and the openness of the presidency."
