The Michigan Daily - Monday, February 7, 1994 - 7 .U.S. senator goes on trial for official misconduct, cover-up FORT WORTH, Texas (AP) - Just months after a landslide victory, U.S. Sen. Kay Hutchison will stand trial today on criminal charges of mis- using her former office of state trea- surer and then trying to cover it up. Facing the possibility of conviction and prison, Hutchison, a rising Repub- lican star, has denied doing anything *wrong "legally, morally or ethically." She says she is a victim of Demo- crats who fear and resent her success. In four indictments, however, pros- ecutors from the Travis County district attorney's office say the real victims are state taxpayers cheated by Hutchison. Hutchison has been charged with using tax dollars for her personal and political gain when she was treasurer, a position she held from January 1991 to June 1993. Prosecutors say she ran political operations out of the Trea- sury, using office employees and com- puters on state time. When investigators got wind of it, they say, she started changing perma- nent computerrecords to hide evidence. The indictments charge her with two felony counts and one misdemeanor count ofofficial misconduct, and felony counts of tampering with a govern- ment record and tampering with physi- cal evidence. Since the alleged offenses are being tried together, prosecutors say Hutchison, if convicted on all counts, could face up to 20 years in prison. "This case is not about politics," said First Assistant District Attorney Steve McCleery. "This case is about ethics in government. It is not a politi- cally motivated case." The trial has its roots in an April 1992 article by The Houston Post, which reported that David Criss, then policy and planning director for the Treasury, was using a Treasury computer for Hutchison's campaign fund-raising. Hutchison admitted that a small amount of non-state work was done on the state computer. But she said she hadn't known about it and would take steps to make sure it didn't happen again. Criss apologized and resigned. The Travis County district attorney's office also concluded that no evidence indicated Hutchison had any knowl- edge of the misuse of Treasury comput- ers.
