Kid 'N Play were arrested in Atlanta in July, charged with an obscene perfor- mance. Even more recently, three members of a rock band, Too Much Joy, were arrested for performing 2 Live Crew songs at a show in Broward County, the same place Luther Campbell and other members of 2 Live Crew were busted. < Sandy Smallens, the bass player for Too Much Joy, said his group pZrformed the songs in that county as a protest and a way to test the county officials' resolve to rid their area of what has been deemed in some circles as obscene speech. "I can tell you, there were comments made at the trial that would lead me to believe it was racist," he said. - But Bruce Rogow, a professor of law at Nova University in Ft. Laud- rdale and 2 Live Crew's attorney, said the charges of racism may be 'kaggerated. "I don't think it's any- thing as concerted as that," he said. 'You know, I don't think anybody said, 'Let's go out and get these Black guys.' But i think that there's no question that race weaves its way ht and out of this kind of prosecu- ,tion," he said. SvTo put this theory to a test, Scarsdale, N.Y. rock group, Too Much Joy, performed 2 Live Crew songs in the same Florida county where 2 Live Crew members were arrested. Too Much Joy bass player Sandy Smallens said he and his bandmates basically issued a chal- lenge to Broward County officials to arrest their band since they are white and most of the previous controversy has surrounded Black groups. Although Too Much Joy was ar- rested, Smallens said he still be- lieves race is a factor in the rise in prosecutions. "Minority groups in arts and on the fringe, like homosexuals and Blacks, are in trouble. They're the endangered species," he said.
