Deputization carries many legal impl Folkminers are gone, but new tape lives on Folkminers Two Feet Down and 1,000,000 Miles High Folkminer Music/Office Records The Folkminers' follow up to their debut EP, and first full-length tape, comes as a treat to those con- fined to only seeing this fine band live. The cassette perpetuates their reputation as one of Ann Arbor finest, and provides proof that then is intelligent music still bein brewed here in the midst of plethora of "creative" mishaps an pathetic cover-bands. The tape is of quite good soun quality - the 'miners productio job is to be applauded. It consist of 13 songs, 12 originals and cover of "Ani Maa'min (I Believe), 's a traditional Hebrew folk song from -- but tie it all together with inno- re g a d d n is a the time of the Holocaust. The music is in the vein of R.E.M., al- though the comparison is so widely utilized it has almost become a platitude. In this case, however, it can be used relatively safely, as anyone familiar with the Folkminers work can attest. They build from the subtlest of blocks - simple bass, rhythmic drums, etc. vative guitar and Athen-esque vo- cals. The majority of the songs tend to remain within the constraints of the easy-rocking, southern-tainted sound, but once in a while break out into more driving cuts, such as "Stranger," which comes close to the fury bottled in Drivin' and Cryin's "Can't Promise You the UL ' World" and "Living By the Book." Granted, it is nice merely to see a local band release a collection of original music, but its twice as re- freshing when the finished product is as tasty as this. --Robert Flaggert Keith Jarrett Trio Still Live ECM Records This new double live date from the "Standards Trio" is as good as it gets. Three cats whose unity is greater than the sum of the parts. Bassist Gary Peacock and drummer Jack DeJohnette have long been leaders and groundbreakers in their own right; with the acrobatic pianistics of Jarrett they shine at their brightest. My personal hero here is Peacock. He brings a breathtaking fullness of sound to the stew, and provides so much more in the way of rhythmic underpinning than just keeping time. In fact, the ritual of deputiza- tion has changed little since those times. "If you think about the sheriff summoning his posse of men and swearing them in as deputies, that's what we're talking about here, " said Washtenaw County Sheriff Ron Schebil. When University public safety officers Leo Heatley and Robert Pifer were sworn in as deputies by Schebil last week, they instantly achieved the status of deputy sher- iffs, with all the powers, privileges and protections that are extended to law enforcement officials under Michigan state law. This event alone profoundly changes the legal issues surrounding acts of political protest at the University. Deputization by the county sheriff is the only means by which the University can acquire police au- thority. Under Michigan law, four year colleges are prohibited from forming their own police forces. Campus security, however, can as- sume nearly identical powers -in- cluding the authority to enforce city ordinances - through the process of deputization.. University deputies, unlike city police, do not have the power of arrest while they are off-duty. However, the University has the discretionary ability to define all the other powers of the deputies through their job descriptions, in- cluding their on-duty, off-duty sta- tus. University deputies cannot arrest students for infractions of Univer- sity policies (such as violations of the protest guidelines). However, student protesters can be arrested by University deputies under state law on charges such as disturbing the peace or trespassing. The following are changes in the legal status of the Public Safety officers who have become deputy sheriffs in the pay of the Univer- sity. Firearms: Deputization confers the right to carry concealed firearms. The specific conditions under which University deputies will actually do so are left to the discretion of the University admin- istration. In the current agreement, Heatley and Pifer need the express permission of Vice President and Chief Financial Officer Farris Womack to carry firearms. The policy says a request for firearms would only be granted for assign- ments involving a large sum of money, assisting the U.S. Secret Service, or assisting an outside law enforcement agency with a felony arrest on campus. There are, of course, no guarantees that Public Safety officers would not encounter students or demonstrators during these assignments. Resisting or obstructing a deputy sheriff: This charge did not apply to Pifer and Heatley be- fore they were deputized: regular public safety officers have no au- thority to serve a warrant or enforce state laws. Interfering with a Uni- versity deputy in discharge of duty constitutes a misdemeanor punish- able by imprisonment in the state prison of up to 2 years, or by a fine of not more than $1,000. Assault upon a deputy. sheriff: Assaulting an officer of the law is a misdemeanor punish- able by a fine not to exceed $1,000 or by imprisonment in the state prison for not more than 2 years, or both. Resisting arrest: This charge is punishable by a fine not to ex- ceed $1000 or by imprisonment for not more than 2 years.
