I E Ballot The Michigan Daily - Thursday, March 5, 1987 - Page 3 proposal labelled 'unconstitutional' By CARRIE LORANGER Michigan's Attorney General's office ha called Ann Arbor's housing millage n proposal unconstitutional and has forwarded it to the governor's office to be re-worded. In late February, the Attorney General's office charged the ballot poposal unconstitutional because the state constitution forbids the use of tax dpllars for gifts, grants, or loans to pgivate companies. The charge is currently being reviewed by Governor James Blanchard's advisors, according to his Press Secretary, Lisa Greyson. If the governor views the millage proposal as unconstitutional, then the proposal will not be allowed to be on the April ballot unless the Ann Arbor City Council votes to overrule the decision. The council would be allowed under state law to override the governor if it voted for the millage by a two-thirds majority vote. BUT THE council may be unable to attain the eight votes necessary for a majority. There are now four Republicans and seven Democrats on council. All of the Republicans and several Democrats are opposed to the proposal. Councilmember Richard Deem (R- Second Ward) said it is unclear where the funds will be appropriated and that he will not vote for it, especially if it is found unconstitutional. Council Democrats said the wording will be changed if the governor's office rules the proposal unconstitutional. Kathy Edgren (D-Fifth Ward) said vacationing City Attorney Bruce Laidlaw may reword the proposal to say that the money will not be loaned or a granted to a private firm, in accordance with the law. In his memorandum to the council Monday, Laidlaw wrote "In my opinion, there are a number of legal uses that could be made of the funds which could be raised by the millage, and therefore the Assistant Attorney General's concerns are unwarranted." DEMOCRATS argue the funds will be used to contract a company, not as a grant or loan. "It is a technical legal concept," said Laracey. "To develop private housing can only be done as authorized by the state law." The housing millage, if passed, would mean that city tax dollars will be put into a fund used to hire builders and decrease the buying or renting price per unit. City Democrats view this as a way to provide affordable housing for people with an income below 60 percent the national average. Some say the millage could mean higher rents for students. Laracey said if landlord's property taxes go up, they usually raise the rent proportionally. POLICE NOTES Armed robbery Ann Arbor police are investigating Tuesday night's armed robbery at Campus Corner on 816 State St. According to Sgt. Jan Sgomala, a white, college-age male entered the store and stole a six- pack of beer after pulling a switchblade knife on the clerk. No suspect has been identified. Break-ins Police are investigating break- ins at seven rooms in the Alpha Delta Pi sorority house on 722 South Forest. The forced entry occurred during mid-winter break, when the main sorority house was locked, but individual rooms were not. Sorority members refused to comment on the incident. According to Suomala, nothing was reported stolen. The Ann Arbor Police Department is also investigating two reported break-ins on the 700 block of South First Street during vacation, Suomala said. According to Moore, the University is paying $90,000 of the total renovation costs. Swisher Realty Co., which owns the building, is paying $160,00. Moore said that finding off- campus space was necessary because of the unavailability of on- campus space and high renovation costs associated with it. Moore said renovations at the University for a computer center would cost approximately $80 per square foot because the buildings are older.
