Among the questions potential jurors were asked was whether they had ever heard of Al Capone, the notorious Chicago mob boss. Mafia history is at the heart of the case as the government tries to prove that from the 1930's until recent months, leaders of the five .mob families based in New York :met periodically as a 'commission" to divide territories, share the spoils of criminal corporations and, some- times, authorize a murder. A 'YES" ANSWER would not necessarily disqualify a would- be juror, but would lead to more intensive questioning by the judge about the individual's knowledge and feeling about the Mafia. Jury selection is expected to take at least several days. Several defendants raised last-minure objectioins but Owen rejected all of the complaints. The defendants also include Gennaro "Jerry Lang" Langella, who was previously convicted of being Persico's second-in- command; Salvatore "Tom Mix" Santoro, the alleged low-level Bonanno family member accused of being a triggerman in the 1979 rubout of Bonanno boss Carmine Galante; and Ralph Scopo, a former contruction labor leader who allegedly delivered payoffs from contractors who were victims of a commission shakedown scheme. Primary vote losers get a second chance LANSING (AP)- Several primary election losers have taken advantage of a quirk in Michigan's election laws to grab a second chance at winning seats in the state Legislature. That quirk is enabling House hopeful Charles Gongdon of Midland, who pulled 15 percent of the vote in the Republican primary, to run a second time against Michael Hayes, who pulled 85 percent of the vote. VIRGINIA Cropsey of Sterling Heights, who got 5 percent of the GOP primary vote in the 9th Senate District; Freddie Kennedy of Detroit, who ran in second in a three-way GOP House primary; and Dick Whitelock of Portland, defeated by a 2-to-1 margin in another Republican House primary, are also back on the ballot. So is John Safran, a Democratic Senate hopeful who lost to a backer of political extremist Lyndon LaRouche.. They're all running without party labels, as independent candidates. "STATE law doesn't address independent candidacies at all," Elections Director Chris Thomas said Monday. "That has been an ongoing problem for the past 10 years." In at least one case, it may pose a problem to Gov. James Blanchard, a Democrat. Blanchard reacted strongly when James Green of Metroma defeated Safran, a retired Methodist minister from Clifford. AFTER GREEN won the Democratic nomination with 60 percent of the vote, Blanchard disavowed the nominee and endorsed a Republican, incumbent Sen. Dan DeGrow of Port Huron. "The governor felt so strongly about the LaRouche candidate and making it so clear that voters didn't vote for him inadvertently because he had the Democratic label that he endorsed I I Republicans.. .he at least could work with," said Gary Buchula, the governor's campaign manager. "I don't know what he'll do now" that Safran, a Democrat for 48 years, back in the race as an independent, Bachula said. MICHIGANlaw hasn't spelled out how independent candidates should get on the ballot ever since a federal court found the state's old system unconstitutional. For the past few elections, candidates have gone to court to get their names on the ballot. This year, state officials got tired of spending time and money in court and allowed independents on the- ballot just by filing an affadavit. The result? "Absolutely, this year is the highest number of independents," Thomas said.
