DESPITE THE concessions, students remained opposed to the code. The new rules, said Lee Winkelman, then MSA's code resear- cher and later, chair of the University Council, had in fact, created some new problems. For example, only students who committed crimes punishable by suspension greater than one semester would have a right to a hearing before their peers. The great majority of cases, then, would be decided by a faculty or ad- ministrator hearing officer. In addition, the students serving on the board would be selected by the University President. The "November draft," also ignored several of the students' con- cerns, Winkelman said. Students could still face 'double jeopardy.' Hearing officers can still limit the participation of an attorney if they consider! them "disruptive." The judicial system is still considered dif- ferently from the rules, so that it can be passed without MSA's approval. And protesters, no matter what procedures the University's Civil Liberties Board comes up with, can still be punished by the University. SHAPIRO had felt that the second administration proposal needed only minor changes, and asked the council to fine tune it. However, the council, composed of totally different members than the last council, chose to start their own draft from scratch. They have never considered the administration's proposal. With Winkelman and Schnaufer, two students who had been involved in opposing the administration's proposals, on the council as well as Social Work Prof. Anne Hartman, who also opposed the code, Winkelman explained that reviewing the administration's draft, would have proved too devisive for the coun- cil. "Our approach, instead, was to take a step back and examine which problems existed and which problems are appropriate for the University to act upon." "The philosophical differences on the council was too great to just start debating," Winkelman said, "We never would have reached a consen- sus." But now, over a year after the coun- cil began starting from scratch, regents say they feel the council has been stalling, and as Regent Sarah Power (D-Ann Arbor) put it, "I think everybody's patience is wearing a lit- tle thin."
