Monday for five filmmakers charged with the deaths of three actors during production of Twilight Zone, in what some lawyers call an unprecedented case that could drive the movie in- dustry out of California. The preliminary hearing before Superior Court Judge Brian Crahan is to determine if there is enough evidence for director John Landis and four others to stand trial on charges of in- voluntary manslaughter for the July 1982 deaths of actor Vic Morrow and two children. Attorney Jerome Berchin, who is F suing the filmmakers and Warner Bros. studio for $200 million on behalf of one child's family, said the very prospect of a trial is unprecedented. "I feel a precedent already has been set," Berchin said. "I think the movie industry has been shaken by this ac- cident ... because it appears that insuf- ficient safety precautions were taken." "It's already had a very substantial effect in terms of insurance, in terms of who's covered under insurance and in terms of some directors' extreme ner- vousness about making some kinds of movies at all," said prominent enter- tainment attorney Tom Pollock. More that $82,000 in fines, currently on appeal, have been assessed by state health and labor agencies against the movie-makers and Warner Bros., which distributed Twilight Zone to theater,last summer. Last June, a county grand jury indic- ted Landis, associate producer George Folsey Jr., production manager Dan Allingham, special effects coordinator Paul Stewart and helicopter pilot Dor- sey Wingo. Wingo was flying the helicopter during early morning filming of a Vietnam war sequence in a riverbed near Balencia, 40 miles northwest of Los Angeles. A powerful special effects explosion disabled the craft and it fell on the three victims, killing them in- stantly. Landis' attorney, Harland Braun, said Thursday that if the case went to trial and Landis was convicted, no filmmaker ever would risk filming in California again. "It's very important because the defense basically is that in dealing with special effects and aircraft, the direc- tor is required by law to hire experts, and that he did hire experts and he used experts and still there was an ac- cident," Braun said. During grand jury proceedings last summer, Twighlight Zone workers testified the filmmakers knew they were violating state laws by using the two children - Myca Dinh Le, seven, and Renee Chen, six - in the early morning hours of July 23, 1982. Folsey and Allingham were charged only in the two childrens' deaths. Charged in all three of the deaths are Stewart, Wingo and Landis, who has directed such movies as Animal House, The Blues Brothers and An American Werewolf in London. If convicted, Landis, Wingo and Stewart face maximum six-year prison terms. The film stars musclebound, teeny-bop trend-setter John Travolta (you'll be thrilled to know Travolta is coming out with his very own exercise book) and Miss "Let's Get Physical," Olivia Newton-John. The movie has all the ingredients necessary to make a bundle of money: two pretty faces, some terrible, but soon-to-be hit music, a bare chest (Travolta's) and wet T-shirts. What more could you ask for? How about a plot? The pickens sho' is lean in this department. At the beginning of the film the Supreme Being decides .that there are no good people left on Earth, and that the eradication of man is his only solution. A group of guardian angels want to save humanity and propose a test to prove mankind's goodness. Zack Melon (Travolta) and Debbie Wylder (Newton-John) turn out - surprise - to be the guinea pigs for this test. It's a pity they didn't drug the "guinea pigs" - that easily would have bettered their acting performances. All right, I'll admit it, Travolta and Newton-John make a cute couple but that probably won't be enough for you, unless you block your ears from the numbingly idiotic dialogue. For curiosity's sake, I decided to see what some other people thought of Two of a Kind. Said one Michigan student ."It was so bad it was gross - you better not mention my name, I'm kind of em- barrassed about seeing the film." Another student said "I took my baby sister to see it and she loved it." The last person I questioned was a bit evasive, but finally whispered, "It's a good movie to see after exams when your mind is all mushy." I think she's got a point there. According to Twentieth Century Fox's press release for Two of a Kind "Certain stars seem to belong together, evoking the kind of chemistry that guarantees audiences a most pleasurable experience . . ." Olivia Newton-John and John Travolta's chemistry set must be missing a few key chemicals. If you're a real fan go see Two of a Kind. Tonight's show is the end of a six performance run, and marks the symbolic end of the Christmas season. p According to Terry Gallager, publicist for the Brecht Company, this show concerns "the massacre of in- nocents by Kind Herod." In this lesser known bible story, Herod has all the boys in Bethlehem done away with from two years of age and under in an attempt to kill the new born Jesus. Despite the biblical subject matter, Arden's play has a modern-day em- phasis. "Herod is seen as a plausible third world politician" according to Gallager. However, the play is "done in the style of medieval mystery plays . . . and was originally written to be performed in a church or any im- provised space." The principle players include Liz Harrell as an angel, Martin Walsh as Kind Herod, and Dominique Lowell as hostess of a Bethlehem Inn. The direc- tor is Bob Brown. The 50 minute one-act includes eight songs, and according to Gallager, should prove to be a "real lively show."
