I Page 6 - The Michigan Daily - Friday, December 2, 1983 Regent must pay $24,000 bill I I By JACKIE YOUNG University Regent Deane Baker (R- Ann Arbor) has been ordered by a Cir- cuit Court judge to pay a Saline con-' tractor more than $24,000 in a dispute over construction of a group of con- dominiums in Ann Arbor. Washtenaw Circuit Court Judge William Ager, Jr. upheld an ar- bitrator's decision that required the Deane Baker Co. of Dearborn to pay York Contracting Inc. $24,198. THE CIVIL suit against Baker's company began in the summer of 1982 when York Contracting filed suit in Cir- cuit Court claiming that the Deane Baker Co. refused to pay bills totaling $35,522 for work done back in 1979 on the Newport West Condominiums in Ann Arbor. Baker Co. attorney's said they did not pay York Contracting the full amount of money because some of the work was unsatisfactory. The Baker Company then countersued York Contracting for $380,000 saying that they were liable for this amount because the faulty work caused a delay of work on the con- dominiums and other problems. Sinceiboth companies signed contrac- ts calling for disagreements to be set- tled in arbitration, an arbitrator made the first judgement on the case. The ar- bitrator awarded York Contracting $24,599 and said that Baker's company submitted their evidence against York Contracting too late. The arbitrator decided Baker Co. had no cause to countersue and didn't award them anything. THE BAKER CO. appealed the decision to Circuit Court. Ager then upheld the arbitrator's decision on Nov. 10th although he modified the payment to $24,198. Last week Ager issued an order calling for the Baker Co. to pay York the money within 20 days. David Foster of Southfield, attorney for York Con- tracting, said so far "to this date they have not paid a penny." If Baker Co. doesn't pay York in the required time Foster said he will go to court to deter- mine what assets he can take to get the money. Richard Sanders of Detroit,one of the attorneys representing Baker Co., said the company hasn't decided yet whether they will appeal the ruling. "The company maintained that York did work that was not up to proper standards," Sanders said. Gordon said police officials told him Wright will probably appeal his dismissal and that Gordon and Adams might have to appear at appeal proceedings. Gordon learned yesterday that charges were not being filed against him in the month-old case.
