IN WASHINGTON, Selective Service spokeswoman Joan Lamb said the agency would have no official comment until it had a chance to review the ruling. University President Harold Shapiro, who in a February letter criticized the Department of Education's proposed rules for enforcing the law, said the court ruling is a positive one. "If it gives the University some breathing space to reassess (the law), I think it is helpful," Shapiro said yester- day. IN HIS LETTER Shapiro said the law would "impose undue and unnecessary time and cost burden" on the financial aid office. The law would also inap- propriately make the University responsible for making sure a student was registered for the draft, Shapiro said. Representative Gerald Solomon (R- N.Y.), author of the amendment to link student aid to draft registration, said that if the Minnesota court injunction becomes permanent, the Selective Ser- vice System would appeal it. He said he felt confident the law would be upheld. "It isn't a question of incrimination," he said. "No one is being found guilty without a trial. We simply added a qualification for student aid." DAN LASS, a staff lawyer for the Min- nesota Public Interest Research Group (MPIRG), said the law is self- incriminating because a student who fails to certify he is registered is Lass also said the law punishes a student through legislation and not a trial. "Government can't deny you con- stitutional rights for administrative convenience," Lass said. "Anyone who has had an eighth grade Civics course knows a law like this is uncon- stitutional. They are selling a student's rights down the river." MINNESOTA CIVIL Liberties Union, which filed the suit along with MPIRG, said it would ask Alsop to set a hearing date where it would try to have the in- junction made permanent. Harvey Grotrian, the University's fin- ancial aid director said the decision might not do any more than delay the law from taking effect for a year. He stressed that the law had over- whelming support in Congress and would be difficult to repeal. BUT GROTRIAN strongly objects to the extra time and work the law would put on the financial aid office, which receives nearly 20,000 applications a year. A University which provides a non- registrant with federal funds would be breaking the law. The student could receive up to five years in prison and a $10,000 fine and lose his federal finan- cial aid. The plaintiffs in the case are six students identified only as John Doe, Richard Roe, Paul Poe, Bradley Boe, Carl Coe and Frank Foe represented by MPIRG and the Minnesota Civil Liber- ties Union.
