BELCHER'S original motives for at- tempting to repeal the law were con- cern over increasing drug abuse in Ann Arbor's high schools and junior high schools and putting to rest the city's "liberal" pro-marijuana image. Although Republicans don't think the answer to the problem is introducing a repeal proposal on the city's April ballot, they said they agree a remedy is needed for Ann Arbor's drug problem. "Our pot law is a famous law that waves a flag and says 'come here to Ann Arbor for getting high,' " said Lou Velker (R-Fifth Ward). "It's a sym- bolic law, and repealing it is attractive to people who want to get rid of that image of Ann Arbor." DEMOCRATIC councilmembers were against the repeal from the start, said Lowell Peterson (D-First Ward). "Repealing the law is a superficial treatment of the problem. I am tired of people playing symbolic politics. Ann Arbor is not the drug capital of the world," Peterson said. If the law had been repealed, possession of marijuana would have been a criminal offense falling under state laws, said Captain Calvin Hicks of the Ann Arbor Police Department. Depending on how much marijuana the offender is found with, penalties can be as stringent as a 90-day jail sentence and up to a $1,000 fine. In most cases, teenagers under the age of 17-who were the targets of Belcher's plan-would be treated the same as they are now, even if the law was repealed, Hicks said. MOST OF Michigan's teenage violators are sent to juvenile court, where the judge usually hands out light fines and refers them to a counselor, he said. Judges almost never impose the4 full penalties of state law in these cases, he said. Raphael Ezekiel (D-Third Ward), however, said state laws and drug abuse are unrelated. He pointed to a study done through the Institute of Social Research by Richard Stuart, which tested the effects of decriminalization of possession of marijuana on the level of high school student drug use. The study, which compared students in Ann Arbor, Dearborn and Willow Run from 1971 to 1974, concluded that during the years of 1972 and 1973-when Ann Arbor's $5 fine was initiated- student use decreased compared to students in cities where marijuana possession was a criminal offense. In those cities student use tended to inten- sify over that four-year period. Velker, however, said the decrease had to do with the mood of the country, not the liberal laws. Marijuana use was, more popular during the Vietnam era, he said, because it was one form of rebellion. Institute researcher Dr. Marty Gold stressed that the results from the sur- vey cannot be generalized to the whole population without repeated testing, and added that the decrease in use can- not solely be attributed to the laws. The future of the $5 fine is left up to local citizens, according to Velker.
