Because of his uncooperative man- ner, the investigators are considering efforts to force President Carter to testify under oath about his ad- ministration's handling of the Billy Carter affair. IN A STILL-SECRET report delivered to members of Congress, the investigators who conducted an inter- nal probe of the Carter administration's handling of the case were critical of the president and his attorney general, Benjamin Civiletti. Sources said Michael Shaheen, head of the department's Office of Professional Responsibility, warned he will report to a "compulsory process"-presumably a subpoena-to get testimony from the president if he does not submit voluntarily. Shaheen relayed this information Wednesday in a status report to the Senate Judiciary subcommittee that made its own investigation of the Billy Case. THE INTERNAL investigation was launched in an effort to determine if the Carter administration acted properly in the handling of a government in- vestigation into the actions of Billy Car- ter, the president's younger brother, who was forced last summer to register as an agent of the radical Arab gover- nment of Libya. Public release of the report was OCITIZEN THE -CLASSIC LOO requested by Sen. Strom Thurmond (D- S.C.) and RichardLugar (R-Ind.). Aides to Sen. Birch Bayh (D-Ind.), chairman of the subcommittee, said the request was being considered but it was not clear how soon a decision would be made. President Carter had pledged at a news conference on Aug. 4 to cooperate fully in all investigations of his brother's activities. ONE SOURCE familiar with the report said Carter's 'obvious purpose" in canceling the interviews was to avoid investigators until after Tuesday's election.
