The Special Joint Committee on Nuclear Energy also said no nuclear power plants should be permitted to operate without an emergency preparedness plan that can be implemented in the case a major ac- cident, which it said could occur here. BUT PANELISTS have not given their final ap- roval to the report and several indicated they want hanges in the recommendations. Ingham County Circuit Judge James Giddings' ruling, issued early yester- day, was denounced hours later on the floor of the state Senate as another in a 'string of judicial actions frustrating Michigan's anti-tax movement. The office has argued Tisch should not be ruled off the ballot on the technical grounds cited hy Ferency's suit. "We're going to have to find a court and get into it under emergency situations... because we're not going to stand still while one judge says no this language cannot be on the ballot," Tisch said. The panel's report calls on the state to petition the federal government for immediate action on a waste disposal plan. "OPERATIONS OF THE plants without such a plan unacceptably endangers the health and well- being of large numbers of people and should not be permitted," the report said. "In the absence of such a solution, we believe it would be both unwise and unconscionable to proceed with commercial nuclear power development in Michigan." There are operating nuclear plants in Michigan near Bridgman, South Haven and Charlevoix and plants under construction near Monroe and Midland. Those being built would not be affected by the com- mittee's proposal. THE REPORT NOTED the state does not have a contingency plan in case of a major accident. But Rep. Paul Henry, (R-Grand Rapids), said he does not think state officials can draw up such a plan. "I'm not sure if we can develop an emergency plan and I'm not sure if the risk is such that we need a detailed plan," he said. Recommended in the report is legislation gover- ning power plant sites.
