The 39-year-old Daniel, son and namesake of one of the state's most prominent political leaders, was found shot Monday night in a hall between the kitchen and carport at his home in this southeast Texas town. Officials said he was slain with a .22-caliber rifle found in a bedroom of the house. Liberty County Sheriff, "Buck" Eckols said no charges were filed im- mediately. He said no action would be taken until he received the autopsy report and questioned Daniel's wife, Vickie, who recently filed for divorce. Reagan, Senate act quickly on Cabinet appointments WASHINGTON-President Reagan, in one of his first official actions, formally nominated his Cabinet yesterday, only minutes after the inauguration. The Senate called a mid-afternoon session to begin confirming his choices. Reagan signed the commissions for the 13 members of the Cabinet and for four appointed to Cabinet-level posts ata brief ceremony in the small but or- nate President's Room, just off the Senate chamber. All of Reagan's nominees appeared certain of confirmation, including his most controversial appointment, Alexander Haig as secretary of state. Labor secretary nominee Raymond Donovan was still under investigation by the Senate Labor Committee and is the only nominee who has not been approved by committee. Donovan's construction firm has been accused of being involved in illicit deals with unions and organized crime. Psychiatrist challenges Garwood insanity plea A prosecution psychiatrist testified yesterday Robert Garwood, the only Vietnam veteran to be tried as a turncoat, was sane during the nearly 14 years he spent behind enemy lines. The defense claims Garwood, charged with desertion and collaboration with the enemy, was driven insane by Viet Cong torture and should not be held responsible for his actions. "He gave me a good, clear account of his conduct during that time period," said Navy Capt. Patrick O'Connell, chief of psychiatry at the Naval Aerospace Medical Institute at Pensacola, Fla. "This account did not in- clude any description of symptoms I would look for in a mental disefse in a psychiatric sense." O'Connell is one of several psychiatrists expected to testify as the prosecution attempts to knock down the defense's case. Kelley urges refund to go with gas rate increase LANSING-Attorney General Frank Kelley urged yesterday that refund provisions be attached to any Michigan Consolidated Gas Co. rate increase, warning the firm might seek massive hikes if a pending divestiture takes place. Kelley charged the parent American Natural Resources Co. is likely to drop Michigan Consolidated this summer and may be "skimming off" valuable storage rights and other assets for less than their fair value. The result, Kelley said, could leave the newly independent com- pany-Michigan's largest natural gas firm-"sick, and in immediate need of enormous rate increases." Michigan Consolidated President Robert Stewart said the separation bet- ween the two companies would have "no significant effect on the company's future rate increase needs." Company officials said a decision is expected early this year on divestiture. They had no immediate comment on Kelley's skimming charge. Mao's widow may get life sentence, not death PEKING-China paved the way yesterday for an expected decision to spare Mao Tse-tung's widow from the firing squad and instead sentence her to hard labor on a remote farm for the rest of her life. China legislator Liu Fuzhi said that Gang of Four leader Jiang Qing and several other defendants could be executed for their crimes of treason during the 1966-67 Cultural Revolution but added "the death penalty may be suspended for two years during which the prisoner will be helped to reform through labor." If a defendant shows reform, the sentence can be reduced to life im- prisonment, Liu said. For over a week, diplomatic sources have reported that China's leadership had decided on this compromise to spare the life of the widow of the late Communist Party chairman.
