My husband and I have been married for two years and have decided to divorce. We don't have kids, and we've made an agreement about *lviding our property. Can StudentJ Legal Services help us get a divorce? A. Yes. If you have reached a property settlement which is agreeable to both of you, you can do-your own divorce with a kit from Student Legal Services, under the guidance of an attorney. First, you'll be interviewed to deter- mine that you fall within the guidelines for the kit. If you do, you'll receive a kit to fill out. Each completed section must be checked by an attorney, and you will e instructed on how to file the documents in court. One caution: We suggest that you not agree to any property settlement until Student Legal Services 1 you have con'sulted an attorney as to your legal rights. Many times, spouses who have not worked outside the home underestimate their non-economic'con- tributions to the marriage. Kits are available for people with children, too.* Q. I was divorced three years ago and my ek-husband was ordered to pay child support of $20 per week for our two children. At the time he was unem- ployed, but since September he's been a full-time teacher earning $22,000 a year. I've asked him to pay more sup- port, but he refuses. Is there any way to get him to pay more through the cour- ts? A, Yes. When there has been a change of circumstances, such as an unem- ployed person obtaining a job, you may ask the court which granted the divorce to order a change in the amount of child support. If you were divorced in Washtenaw County, a lawyer from Student Legal Services can represent you in court. Even if you were divorced in another county or state, we can advise you of your rights. Q. My husband, who is not a student, filed for divorce and is seeking custody of our two children. I've talked to a few attorneys in town, who have said I'd need to come up.with $500 before they'd represent me in a custody case, and that the total cost will be as much as $2,000 to ;3;000. How much do you charge for this kind of case? A. The services of attorneys at Student Legal Services are provided free to all students. The only costs you pay are court costs, which in a divorce are usually less than $100. There may be additional fees in a child custody case, such as fees for expert witnesses or other related costs. Q. What is a no-fault divorce, and who can get one? A. A "no-fault',' divorce is the only kind of divorce which can be obtained in Michigan. The "no-fault" law, which was enacted several years ago, established that the only grounds for divorce are that there has been a breakdown in a marriage relationship, and that the objects of matrimony have been destroyed so that the marriage qpnnot be preserved. In order to obtain a divorce, you tnust have been a Michigan resident for six months before you file. If you have no children, there is a two month waiting period from the time you file until the earliest date for obtaininig a judgment. If you do have children, the waiting period is six months.
