Title IX vicissitudes . .
...who really needs equality anyway.

I'm glad. Finally the federal gover-
nment-all three branches that is-has come
to its senses.
All I want to do is throw my head back and
laugh, ha ha. Goodbye Title IX. Farewell.
Adieu.
It became obvious to me as I inquired into
the administration enforcing Title IX, the
Department of Education's Office for Civil
Rights (OCR), that what they were trying to
do was crazy. Equality, who needs it?
We need some legislation that forces all
educ tional institutions, to provide equal
athletic opportunity to all students, like we
need holes in! ourheads.
In the not-too-distant past there was great
controversy over Title IX. Cases were filed in
courts all over the land. OCR wanted to force
academic institutions to accept its policy in-
terpretation of the law. If the institutions
refused, OCR would cut off federal assistance
to the entire university.
I began to lose hope.
Were we ifiales really going to lose the
superior status we were supposed to have?
No. Slowly but surely disputes arose.
Athletic departments that did not want to
shell out the extra bucks to put their women's
programs (what a laugh) on the same level as
their men's, voiced objections.
In court, athletic directors and school of-
ficials argued that if the federal government
gave no money to a specific program, federal
administrators could not tell that program
how to spend its money. Since no athletic
departments receive federal assistance
directly, athletics would be exempt from.Title
IX.
Recent senate bill
Recently, a bill was introduced into the
Senate and approved by voice vote. The bill
issued by Senator Orrin Hatch (R-Utah) wan-
ts to severely limit Title IX. It has four major
points:
-It will limit the ability of Title IX to cover
programs that are not directly federally
assisted.
-Institutions whose students receive
federal financial assistance would be exempt
if the institutions do not receive aid.
-It makes clear that employment prac-
tices are not covered under Title IX at all, but
under Title VII.
-It explicitly acknowledges that Title IX
has jurisdiction over admissions. (Oh well, no
law is perfect.)
Our pals in the Reagan administration
struck another .blow against Title IX. They
are conducting a re-review of the entire
Department of Education. That could result
in laxing of the enforcement of Title IX.
The Department of Education has already
changed its policy of threatening to cut off
federal funds, according to University
Athletic Director Don Canham. "If there is a
complaint (involving Title IX) they (OCR)
will write you a letter and tell you (the
athletic department in question) to look into
the matter," said Canham.
Leaving the equality decisions up to the
academic institutionstcould be bad for some.
At a few institutions the athletic directors sin-
cerely want to make equal opportunities for
male and female athletes. This could put us
right back where we were before the tide of
reform rolled in.
What a'relief
But not all athletic directors favor OCR's
guidelines for equal opportunity. Many have
voiced objections to OCR regulations in court.
Thank heaven.
Any sensible citizen knows that throughout
history all nations have discriminated against
women in some way or another. Why should
we be different? Are we loonies? Everyone
knows that men are more athletic than
women, they therefore should have more
athletic opportunities.
Let's face it, we-all know that athletic
departments around the country are capable
of running themselves. They will consistently
decide to do what is right, not what is
cheapest.
"You don't have to put teeth in a law. The
law of the land is the law of the land," said
Canham. "You got a million laws but you
don't have the federal government coming
around threatening you if you don't abide by
this (any) law. And if you break the law
they're not going to take away your bir-
thright."
I think this could be applied to other areas.
Why can't corporations regulate themselves?
Why do we need those silly antitrust laws?
Why regulate anything? Why keep the IRS?
After all we're Americans. We wouldn't cheat
the government. It's against the law. The tax
law doesn't need teeth in it. No need to enfor-
ce it. Just have us turn in our taxes on the
honor system. Boy would that cut down on the
federal beauracracy.
What the hell, let's give it a try. Tear down
these laws. Write your congressman today.
Come on, let's help those federal officials
keep the ball rolling. Title IX today, the
criminal code tomorrow!

With a goal by senior forward Betsy
Coke six minutes into the second half,
the Michigan women's field hockey
team was able to defeat Western
Michigan 1-0 yesterday at Ferry Field,
upping its record above the .500 mark
(5-4-1) for the first time this season.
Despite the Wolverine victory, it was
the Broncos who controlled the game,
totally dominating the first half.

"We definitely dominated the game
offensively and if it hadn't been for
Michigan's goalie, we probably would
have won 30-0," said Western Michigan
head coach Jean Friedel. "Although, of
course, I was disappointed with the
game's outcome, I was really surprised
that we were able to move the ball so
well against a team which has a
reputation this year ' as having a strong
defense."
Wolverine freshman goalie Jonnie Lee
Terry, who was awarded the team's
defensive player award for the game
was impenetrable, chalking up a total
of eleven saves.
Despite the fact the Broncos were
able to control most of the game,
Wolverine head coach Candy Zientek
said she was satisfied with her team's
performance. "We were not as quick to
the ball as we usually are," she said.
"But this is our fifth game in six days
and I think we are due for a well eatned
rest."
The stickers next game will be 0^-
tober 13, when they host Bowling Green.
