l The Michigan Daily-Friday, February 1, 1980-Pc California hunters sentenced to life *after killing man OROVILLE, Calif. (AP) - Two white men who boasted that they killed a black man because they failed to find any animals to shoot on a hunting trip, face possible life imprisonment after pleading guilty to murder. James McCarter, 20, and Marvin Noor, 19, will be sentenced Feb. 27 after pleading guilty Wednesday to the first- degree murder of Jimmy Lee Cam- pbell, 20. CAMPBELL, A deaf man who' worked in a sheltered workshop, was walking along a railroad track Jan. 13, 1979, when he was hit in the shoulder with a .30-caliber rifle bullet that passed through his heart, authorities said. McCarter and Noor were arrested the next day, along with Noor's girlfriend, Dani Lee Shope, 24. She pleaded guilty second-degree murder in November and drew a term of 15 years to life in prigon. "If they had kept their mouths shut, we never would have found them," said District Attorney Will Matley. "But they went home and bragged to friends and neighbors. We got an anonymous telephone call and arrested them." "THEY ADMITTED all this after- ward," Matley said. Matley said there was "evidence Noor had a dislike for blacks." He said McCarter, who fired the fatal shot, i'was actually the meekest of them all. THE POSSIBILITY of the death penalty was eliminated in exchange for the guilty pleas, which were negotiated over the many months after the mur- der, Matley said. Matley said the two men and Miss Shope had gone hunting for deer in the Oroville area, about 150 miles northeast of San Francisco, but were unable to find any. Frustrated, they said they decided to shoot a cow but could not find one. "There was a whole lot of drinking going on, a whole lot," Matley said. He said they talked about finding a black person to kill and headed for nearby Chico. State chief urges Dems. to accept primary ruling LANSING (UPI) - Michigan Democratic 'chief Olivia Maynard urged Senate Democrats yesterday not to sue their party's national committee over its rule prohibiting open primaries. At a caucus meeting, Maynard asked Ohe lawmakers to resign themselves to selecting the state's 1980 Democratic presidential favorite at party caucuses. DEMOCRATIC National Committee (DNC) rules prohibit open primaries such as Michigan's on the grounds they allow cross-over voting that distorts election results. An attempt by the legislature to bring the state's primary into compliance with national Democratic rules passed n the Senate but stalled in the House. As it now stands, Democrats will choose their national convention delegates at party caucuses starting April 26. Republicans will select their presidential favorite in a May 20 state primary. A DEMOCRATIC ballot will be available in the May primary but President Carter has opted out of the election at the request of state Democratic officials. California Gov. Edmund Brown Jr. has said he will enter the primary and Sen. Edward Kennedy (D-Mass.) has not yet made a decision. Despite party leaders' pleas to accept the caucuses, primary backers - buoyed by the success of a similar suit in Wisconsin - are proceeding with a request that Attorney General Frank Kelley sue the DNC to void the election ban. The DNC is appealing the Wiscon- sin Supreme Court decision. MARIE (UPI)-A chemical tanker containing more than 2,600 gallons of methylane chloride flipped on its side and ruptured early Wednesday. Police evacuated a dozen families as a precaution agaisnt toxic fumes. Police Chief Edward Edwardson said a potential disaster was averted because the extreme cold prevented the eaking liquid from vaporizing. Methylene chloride is a solvent used in industrial and home cleaning com- pounds. THE ACCIDENT occurred shortly before 6 a.m. EST on northbound I-75 about a mile south of the International Bridge which links Upper Michigan \with Ontario. Time trials for the I-500 snowmobile race, scheduled to begin at 10 a.m., were postponed for several hours at a racetrack adjacent to the freeway. Edwardson said the families were allowed to return to their homes4hree hours after the accident upon assuran- ces from the Dow Chemical Co., which manufactures the chemical, there was no danger. "WE WANTED to be absolutely sure for the safety of the residents -in the immediate area there, and until we had the experts from Dow on the scene we wanted to take that precaution," Ed- wardson said. The Dow crew assisted city police and fire department workers in cleaning up the' spill. The remaining chemical in the disabled tanker was pumped out for removal.
