S. Supreme Court Justice Thurgood Mar- shall refused to block the sale. The sale was delayed from 10 a.m. to after 6 p.m. while attorneys for New York State and environmentalists argued against it before Marshall in Washington. THE ENVIRONMENTALISTS sought a detailed study of the effects of the drilling off the Mid-Atlantic coast from Long tsland, N.Y., to Virginia. As the arguments went on, sundreds of oil company exec- 'itives milled about a hotel ball- room in New York, waiting for the sale to begin. "The biggest cost of these delays is to the public," Exxon Corp. spokesman J. R. Jack- san said of the wait. "Every day we delay, we lose a certain fraction of production that we can't make up - and we add a fraction to imports." IN THIS RULING, Justice Marshall said only that the Sec- ond U. S. Circuit Court of Ap- peals had acted properly Mon- day in deciding to lift a lower court's ban on the sale. He said he would issue a written opin- ion later. Last week, U. S. District Judge Jack Weinstein barred the sale, saying environmental interests should have been con- sulted more fully. The appeals court then overturned his deci- sion. The Supreme Court is in re- cess, but Marshall has jurisdic- tion over the Second Circuit Court District. INTERIOR Department offic- ials said the case was the first on offshore oil lease sales to reach the high court. Previous efforts to block lease sales off Louisiana, California and in the Gulf of Alaska all failed. Earlier in the day, the oil companies had submitted sealed bids thought to run into hun- dreds of millions of dollars for the right to search for oil in an 876,750-acre area 45 to 90 miles off Long Island, New Jersey, Delaware, Maryland and Vir- ginia. The Interior Department esti- mates the area holds a poten- tial 400 million to 1.4 billion bar- rels of oil, but no one will know for sure until drilling starts. The highest single bid for any lease sale was one for $211.99 million offered three years ago for a tract in the Gulf of Mexi- co. The record total for bids came in 1974, when a sale of tracts off Louisiana brought $209 billion. The high bidders on each tract in a sale win the right to search for and produce oil and gas. Leases not developed in five years are forfeited.
