Barbara Johnson, a travel agent, said she had the coat made for $1,600 in Montreal four years ago, shortly after federal regulations were adopted mak- ing any article requiring the destruction of an endangered species liable for seizure. THE OCELOT is a small, spotted South American cat and is on a list of more than 300 animals termed "endangered species" by the U.S. Fish and Wildlife Service. The U.S. attorney's office sted the coat Thursday and also sued a Nile crocodile attache case whose owner so far is not con- testing. Under the law, the government can file stit against the ani- mal or animal product to con- fiscate and destroy it. "I HAD NO IDEA ocelots were an endangered species when I got the coat," said John- son. "How's a poor ordinary citizen supposed to know? This is a case of bureaucracy at work and confiscating the coat won't put the skins back on any ocelot." "THE SUITS hopefully will cut down on the demand for products made out of endang- ered animals," said McGurk. "If the coat is seized it will be destroyed because its mere existence is a temptation to others. Leonard Matlovich for homosexuality, but the judge pleaded with the armed forces to change its policy. Matlovich said he would ap- peal. "We're going to fight and we're going to win and if we don't win intthe courts we'll win in Congress." REFERRING to a Virginia case in which the Supreme Court summarily affirmed a law against sodomy, District Judge Gerhard Gesell said "it's now clear that there is no con- stitutional right to engage in homosexuality." All that remained, the judge said, was whether Matlovich could overturn the decision of an administrative board and two secretaries of the Air Force in affirming his discharge. Matlovich claimed that if his attack on the regulation itself failed, he qualified tinder spe- cial exceptions because of his 10-year service record and num- erous decorations. "It cannot be said that the Air Force regulation at issue here is so arbitrary," Gesell said, adding that appeals courts have "severely limited" the ability of courts to interfere - with military decisions."
