Killers, who committed at least 13 murders in Dade County and several of whom are known or suspected, cannot be prosecuted, according to State Attorney Richard Ger- stein. GERSTEIN attributes the loop- hole to the U.S. Supreme Court and a ruling of the Florida Su- preme Court. On June 29, 1972, the U.S. Supreme Court "cre- ated a hiatus in capital punish- ment" by declaring it illegal, Gerstein said. The Florida Legislature rein- stated capital punishment Oct. 1, 1972. But the state Supreme Court ruled subsequently that, since there was no capital pun- ishment during the three-month period, then there were no cap- ital crimes, and murder thus fell into a lesser category sub- ject to the two-year statute of limitations. Attorney General Robert She- vin confirmed the situation Thursday. It involves all mur- ders committed in Florida be- tween June 29 and Oct. 1, 1972. Shevin said he is unable to de- termine the number of murder cases involved throughout Flori- da.
