'Political hack'
gets Senate nod
to Consumer
Product board

WASHINGTON (A') - Reversing itself,
the Senate yesterday confirmed the
nomination of John Byington to the Con-
sumer Product Safety Commission.
The vote was 45 to 39. The nomination,
rejected Monday, was revived earlier
yesterday when senators agreed 46 to 37
to reconsider their earlier vote. Vice
President Nelson Rockefeller presided,
apparently to break any tie.
OPPONENTS of the nomination de-
scribed Byington as "a honorable man,"
but said he lacked a strong commitment
to consumers.
Sen. oJhn Durkin (D-N.H.), one of the
most vehement opponents of the appoint-

ment, said, "The only qualification the
man had is he happened to come from
the President's home town."
After the vote, the Consumer Federa-
tion of America, which had opposed the
appointment, issued a statement saying
it was "discouraged and exacerbated
that the. Senate has today nullified its
original demonstration of good sense and
independenceby confirming a political
hack to a key consumer protection po-
sition."
BYINGTON, 38, is a native of Grand
Rapids, Mich., Ford's hometown.
The original vote to reject the nomina-
tion was 37 to 33. Supporters, led by Sen.

Robert Griffin, the assistant Republican
leader, had argued that the Monday
vote represented too small a percentage
of the Senate membership.
A key issue cited by the opponents was
Ford's intention to designate Byington
chairman o fthe five-member commis-
sion.
Sen. Warren Magnuson (D-Wash,),
chairman of the Senate Commerce Com-
mittee which held extended hearings on
the nomination, said the panel had noti-
fied the iWhite House that it would be
willing to confirm Byington as a com-
mission member if he were not desig-
nated chairman.
