DEFRAUDED MORE THAN $20 MILLION
Meat packers indicted

OMAHA, Neb. S ) - A fed-
eral grand jury yesterday hand-
ed down a 105-count indictment
charging two of - the nation's
largest meat packers and their
top officers with conspiring to
d e f r a u d nearly 900 live-
stock feeders of more than $20
million shortly before filing for
bankruptcy last January,
The indictment names Ameri-
can Beef Packers Inc- (ABP),
Omaha, and its wholly owned
subsidiary, Beefland Interna-
tional Inc., Council Bluffs, Io-
wa, along with Frank West,
Beef Packers founder, president
and board chairman, and his
most trusted advisor, Robert
Lee, Beef Packers' vice presi-
dent for livestock procurement.
THE INDICTMENT charges
the defendants with making
large cattle and hog purchases
when they knew Beef Packers
could not pay for them, and
with diverting accounts receiv-
able funds from creditors.
It alleges the conspiracy cul-
minated Jan. 7 when Beef
Packers filed for protection
and reorganization under Chap-
ter 11 of the U.S. Bankruptcy
Act,
In addition, West and Donald
Carlson, manager of the Beef
Packers plant in Omaha, are
named in a second indictment
alleging they bribed federal
meat graders working in Beef
Packers and Beefland plants,
THE CONSPIRACY charges
center on financial transactions
in the days immediately preced-
ing the bankruptcy filing.
Add a little crushed garlic to
lemon juice and use as a baste
for broiled chicken.

In one count, which is typi-
cal, the defendants are charged
with having a $5,000 load of
livestock transported from Am-
herst, S.D., for slaughter in
Council Bluffs, "knowing the
same to have been stolen, con-
verted an dtaken by fraud."
U. S. Atty. Daniel Wherry
said the indictments climaxed
an eight-month probe by his of-
fice, the FBI, the Packers and

Stockyards Administration and
postal service inspectors.
Wherry said the indictment
covered transactions involving
feeders in 16 states, but an as-
sistant later said there might
b only 13 states involved.
He listed Iowa, Nebraska,
Texas, California, Oklahoma,
South Dakota, Minnesota, Wyo-
ming, Colorado, New Mexico,
Missouri, Kansas and Indiana.
