(AP) -- Activist lawyer William Kunstler was jailed for two hours yesterday by the judge in the Joon Little murder case after the attorney challenged "the quality of jus- tice" in North Carolina courts. J u d g e Hamilton Hobgood found Kunstler in contempt of court following a brief exchange in the courtroom, where Kun- stler unsuccessfully had sought admission as defense counsel for Miss Little. KUNSTLER, who also was barred from the trial area of the Wake County Courthouse, called Hobgood's action a "total miscarriage of justice." "It should offend the de- cency of every thinking person in North Carolina and the coun- try," Kunstler said. "I think this man is determined to con- vict this woman by any means necessary." At a news conference yester- day afternoon, Kunstler said ob- servers would be stationed in the courtroom daily to gather material for a possible civil suit against Hobgood. KUNSTLER said the first courtroom observer would be Philip Hirschkop of Alexandria, Va., a board member of the American Civil Liberties Union. Kunstler was attempting to replace Atty. Dees had handled most of the interviewing of witnesses in the trial of Little, a 21-year-old black charged with murder in the slaying of a white Beiufort County jailer. LITTLE claims she stabbed Clarence Alligood, 62, with an icepick to ward off a sexual attack in her cell. The state con- tends she killed Alligood during an escape. Jerry Paul, chief defense at- torney in the trial, moved at the start of yesterday's session to have Kunstler admitted. 1ob- good immediately denied the motion, noting that he was do- ing so "in the discretion of the court, on the grounds that you now have six attorneys repre- senting the defendant." Kunstler moved to the front of the courtoom's pubiic area. Leaning against the rail sepa- rating the bench and public areas, he said, "I see the cual- ity of justice in North Carolina has not improved." "IF YOU make any further comments, you will be sen+ to the fifth floor," Hobgood said, referring to the jail area, "Take me up there. What you're doing is outrageous," Kunstler replied.
