State (near GINO'S) 662-3969 Opt (Continued from Page 3) However, Tommelein stated yesterday that he and Evans had written answers to 68 ques- tions from the Sheriff Depart- ment, but refused verbal re- ports "after the FBI (which is also conducting an investiga- tion into the incident) and our attorney advised us to do-so be- cause of the civil suit." Harris has complained that Evans and Tommelein refused to give a verbal report of the incident. However, Tommelein yester- day refused to discuss details of the incident. "I don't want to jeopardize my'attorney's case," he contended. ZAKRZEWSKI claimed the two fired deputies are innocent of misconduct. "They had no reason to do any of the stuff charged," he said. "They re- ceived full cooperation from the band. "I'm not trying to put whip- ped cream on a bad cake,"' Zakrzewski explained. "T h e band didn't give them. (Evans and Tommelein) any jive con- duct, and these guys just wouldn't have acted that way (referring to the alleged bru- tality). I know these guys" However, Harris has pointed out that his agency had received "some citizen complaints (on Tommelein) for similar activi- ties in the past, which the de- partment investigated but could not prove." BUT Tommelein contended, "I have never even had a writ- ten reprimand of any complaint. This (the Blue Magic charges) is the first time I've received anything like that." Zakrzewski said that the sher- iff department is supposed to inform its officers of a citizen's complaint when an investigation is conducted. Tommelein was surprised at his firing but believes some- one in the department may be persecuting him for his relation- ship to former Sheriff Doug Harvey. "There may be politi- cal pressure from somebody." L 0 C A L political observers have emphasized a major rift between Postill and Harvey. Zakrzewski contended that Tommelein was questioned by superior officers a year ago about frequenting a bar owned by Harvey, and then advised not to patronize the bar. But Harris yesterday declared, "That's a flat-out lie," and em- phasized the bars an officer goes to while off duty is never questioned. HOWEVER, Tommelein reaf- firmed Zakrzewski's claim. "I was called into one of the offices down at the department and questioned about going to the bar during my vacation." The Teamsters Union last week filed a grievance with the sheriff for the firing of Tom- melein and Evans. Postill has agreed to go into arbitration after he and the union agree on a state arbitrator.
