Forest at Hill St.-668-7622 Sunday Worship at 10:00 a.m. House pushes Tellico dam work WASHINGTON (UPI)-The House voted yesterday for completion of the $119 million Tellico Dam in Tennessee although the Supreme Court has ruled the project must be halted to save a species of tiny fish from extinction. Language to that effect, offered by Rep. John Duncan (R-Tenn.) was ap- proved by voice vote as an amendment to a $10.1 billion public works ap- propriation. But it was uncertain whether this would be effective in reversing the decision in favor of the snail darter. DUNCAN SAID he believed it would. One of his aides noted the Tennessee Valley Authority had leaned heavily on continuing appropriations for the dam as evidence Congress intended its com- pletion. The aide said the language added to the money bill was meant to clarify "the intent of Congress." However, the Supreme Court's 6-3 decision Thursday was based on the majority's reading of the Endangered Species Act, which would not be changed by the Duncan amendment. THE OPINION by Chief Justice Warren Burger said the language of the Endangered Species Act indicated "beyond doubt" that it was the intent of Congress to protect rare forms of life such as the three-inch snail darter. "The plain intent of Congress in enac- ting this statute was to halt and reverse the trend toward siecies extinction, whatever the cost,"the opinion said. While it was uncertain what effect the Duncan amendment might have, there is a move under way in Congress to amend the Endangered Species Act it- self to exempt major development projects from such restrictions. Awaiting action by the Senate is legislation that would create a seven- member board with power to review future federal projects and grant these exemptions under certain conditions.
