Wednesday, June 1, 1977 THE MICHIGAN DAI Judge denies Hanafi Moslem LY page Nine -- Pae-~ n move for W A S H I N G T O N (A - The murder - kidnapping trial of Hamaas Abdul Khaalis and 11 of his Hanafi Moslem follow- ers got under way yesterday as a judge denied a motion to dismiss all charges and fenced repeatedly with defense attor- neys. Though jury selection had not yet begun, sparks flew from the outset of the proceed- ings, potentially the longest in the history of the city's local courts. SUPERIOR COURT Judge Nicholas Nunzio rejected a host of defense motions and com- plaints, with more pre-trial ar- guments certainto come before the screening of 500 prospective jurors begins. Opening trial ar- guments aren't expected for a week or more. The most important ruling came when the defense at- tempteduto have the case throws out on the ground that the government may have dis- couraged prosecution witnesses frotm talking with defense law- vers and investigators. The go: ernment denied the charge, and Nunzio denied the motion. The 12 were charged in a 32- count indictment after they allegedly seized 149 hostages and three buildings March 9-11. THE TAKEOVER, tied to a blood feud between the small lanafi sect and the Black Mus- lims, ended peacefully when three diplomats from Moslem cotntries talked the gunmen into surrendering. Ntnzio had barely taken his chair when Ehaalis' attorney, forterwSuperior JudgeH arry Alexander, rose to complain dismissal of charges about the conditions in the courtroom, which, though spe- cially renovated, was cramped and noisy from the sheer num- bers of defendants and attor- neys. "This is ridiculos," he said. "Lawyers jammed together, accused jammed together . .." Nunzio promptly ordered his former colleague: "Mr. Anex- ander, take your seat. This is what we have." SECURITY WAS the tightest ever for a Washington trial, with an electronic search made of everyone entering the build- ing and a second search made of those who actually went into the courtroom. I Khaalis and his co-defendants appeared in informal attire. He and several of the others salut- ed their Hanafi comrades among the spectators, including a dozen veiled women. Many persons predicted a battle of ego as well as legal wit between Nunzio and Alex- ander, who left the bench last year.
