() - The commander of t h e Mississippi National Guard told the Presi- dent's Commission on Campus Unrest yesterday that law offic- ers violated an agreement to leave t h e campus of Jackson State College the night two young Negroes were shot to death. Maj. Gen. Walter Johnson re- fused, however, to state flatly that state troopers and city po- lice mishandled the situation. Asked if he thought there would have been any killing if the operation had been turned over to the military, Johnson replied, "There might not have been or there might have been." He said he couldn't make spch a judgment since he wasn't pre- sented with that situation. Commission member Joseph Rhodes, 22, a Harvard Univer- sity fellow, pressed Johnson to give a personal evaluation of the effectiveness of the highway patrol in confrontations with blacks, but Johnson repeatedly refused to answer. "We have had a lot of testi- mony that the police and high- way patrol are likely to shoot black people - that's their in- clination," Rhodes snapped an- grily. "You have to make some judgment." Another commission m e m- ber, Dr. James Cheek, president of Howard University, accused Johnson of giving "political an- swers." Johnson said it had been agreed upon by Gov. John Bell Williams and state and local law enforcement officers that civil- ian law officers would leave the campus if the National Guard was summoned. "They were to get out of the area," Johnson said. "It was to be a military operation from that point on." .Regent Smith, appointed to Oakland post Retiring University Regent Otis Smith has been named to the f i r s t governing board at newly independent O a k I a n d University. He was named to the position by Governor Milli- kin. Smith, a Democrat, is an as- sistant general counsel at Gen- eral Motors and a former State Supreme Court Judge. Daniel Berrigan, the Jes- uit priest w h o eluded federal authorities for four months, was given the khaki garb of a federal prison yesterday as he began serving a three-year sen- tence for burning draft files. Father Berrigan, 49, who was arrested by FBI agents Tues- day on Block Island, R.I., was brought here from the Rhode Island Correctional Institutiop by two federal marshals about two h o u r s before a planned noontime rally for him in Prov- idence. The Bureau of Prisons in Washington said Father Berri- gan's brother, the Rev. Phillip Berrigan, 47, who is serving a six-year sentence at the Lewis- burg, Pa., federal prison for de- stroying draft records, also will be transferred to Danbury.
