A major action by the guerril- las could provoke a heavy re- prisal by the Israelis and jeo- pardize the U.S.-sponsored standdown that went into ef- fect Friday. Meanwhile, Israeli Ambassa- dor Yitzhak Rabin flew back to his Washington post unexpect- edly yesterday amid reports that Israel was preparing two notes to the United States protesting certain statements about t h e Middle East cease-fire. The Israeli government h a d accepted the U.S.-sponsored cease-fire with the qualifica- tion that Israeli troops would not withdraw from occupied Arab territory until there was an Israeli-Arab agreement on "secure, agreed and recognized boundaries." That key statement was not included in. the United Nations announcement of the revival of Swedish Ambassador Gunnar Jarring's Middle East peace mission. The guerrillas, operating pri- marily from Lebanon and Jor- dan, have pledged to sabotage the cease-fire and they already have increased attacks on Israeli patrols and border set- tlements. The Israelis hit back with an air raid into Lebanon Sunday -the first big combat flight of the warplanes since the cease- fire. The surge in guerrilla activi- ties was in sharp contrast to the war's major battle a r e a along the Suez Canal, where' Israeli and Egyptian troops were massed on each side of the waterway. There, complete calm prevailed for the third-straight day. The Israeli command in Tel Aviv reported two guerrillas killed and a third captured yes- terday in the latest clash south of the Dead Sea. A spokesman said the Israeli patrol that flushed the guerrillas suffered no casualties. Palestinian guerrillas in Beirut said they lost eight killed and two wounded Sunday--four dy- ing in one of the Israeli air raids into Lebanon. In Amman, the guerrilla news- paper Al Fatah warned t h e Palestinians to "prepare for a decisive battle" with the Jor- danian army. It claimed that ire with the cease-fire now opera- tional on Jordan's orders, the Jordan army was bringing troops and armored vehicles to Amman, apparently in an effort to clamp down on the thousands of guerrillas operating in Jor- dan. Jordan and Lebanon have promised to observe the truce, but claim they are powerless to control the guerrillas. Israel says it will retaliate for any guerrilla attacks. Informants close to the mili- tary in this area near the Jor- danian and Lebanese borders say the army is awaiting some sort of major guerrilla action to which it may have to reply. Security measures already have been intensified in Israeli border settlements and in army positions. The sources say it is not cer- tain what sort of action can be expected. It could be a suicide attack on an Israeli settlement by large numbers of guerrillas, they say. Infiltration might b e c o m e deeper and more daring. Or there may be a repeat of last May's guerrilla attack on a school bus on the Lebanese bor- der which killed eight Israeli children. ()-A three-judge fed- eral panel upheld yesterday the Army's right to court-martial two s o 1 d i e r s charged in the alleged massacre at My Lai, South Vietnam, in March 1969. The ruling came on petitions filed in behalf of Sgt. Esequiel Torres, 22, of Brownsville, Tex., and Spec. 4 Robert T'Souvas, 21, of San Jose, Calif. They are two of the 12 soldiers charged in the al- leged massacre. Attorneys for Torres and T'Souvas had asked the three-judge panel either to en- join the Army from bringing the two sol- diers to trial by court-martial or to trans- fer their cases to federal court. The peti- tions, almost identical, had contended the Army trial would violate Torres' con- stitutional rights on 15 grounds and T'Soufas' rights in 17 instances. The decision noted that the Supreme Court has recognized that a trial by military tribunal deprives one of trial by jury and other constitutional right "However," it said, "the court has not ruled the U.C.M.J.-Uniform Code of Military Justice - unconstitutional . . . and this court will not hold the U.C.M.J. unconstitutional for deficiences which the Supreme Court has long acknowledged in those cases which are properly subject to military justice." It said, "There can be no doubt that the plaintiffs are subject to military juris- diction as both are members of the armed forces and, clearly, the alleged crimes are service connected." The three judges said they are unwill- ing to presume that the military courts will not fully and fairly consider the claims of the two soldiers and, therefore, "we find there is insufficient reason to depart from the well-established policy that, once a member of the armed forces commits an offense and the military jus- tice process is initiated, the federal courts will not interfere until that process has been exhausted." The judges also said that the ruling "should in no way be read as casting light on the merits of plaintiffs' due process contentions. "We have not rejected the claim on command influence, pretrial publicity and the other matters proffered," it con- tinued. "We have merely rejected plaintiffs' argument that it would be fundamentally unfair to require these matters to be first raised in the military courts. Our ruling relates tothe timing, rather than the merits, of this suit." The seven-page decision was signed by Judge Griffin Bell of the 5th U.S. Circuit Court of Appeals, along with U.S. District Court Judges Sidney Smith Jr., and Al- bert Henderson Jr. A similar action, filed in behalf of S. Sgt. David Mitchell, 29, of St. Francis- ville, La., is still pending before a U.S. District Court in Waco, Tex. It was pre- sumaply postponed pending a decision in the Atlanta suit. Aug. '70-Aug.
