Specifically approving Florida's six- member jury system, the court said the state may settle on any number of jurors as long as the "common-sense judgment of a group of laymen" stands between the accused and his accuser, "The fact that the jury at common law was composed of precisely 12 is an historical accident, unnecessary to effect the purpose of the jury system and wholly without significance except to mystics," Justice Byron R. White said for the court. In another major criminal-law decision, the court held that indigent accused peo- ple have the right to a lawyer's assistance at preliminary hearings. This is the point at which a magistrate decides whether there is sufficient evi- dence to give the case to a grand jury. The ruling requires Alabama courts to reconsider the assault convictions of John Henry Coleman and Otis Stephens, two Birmingham men sentenced to 20 years in an attack on a motorist and his wife. On a 5-3 vote the court established the rule that defendants charged with crimes that carry prison sentences of at least six months are entitled to be tried by a jury. All the states and the federal govern- ment already follow the practice. The ruling directly affects only New York City. In other actions the court: -Agreed to decide whether the federal government is unconstitutionally sup- porting religion by making construction grants to church-run colleges and univer- sities, -Agreed to hear an appeal by Paul R. Cohen, a Los Angeles youth convicted of disorderly conduct for wearing a jacket with an alleged obscenity on it, -Rejected 5 to 3 an appeal by eight East Tennessee State University students who were suspended for distributing leaf- lets on campus. By a lopsided vote of 79 to 5, it ap- proved an amendment by Sen. Robert C. Byrd (D-Va), to the so-called Cooper- Church proposal that has been the ob- ject of six weeks debate. The Byrd language says that nothing in the proposal of Sens. Frank Church (D-Idaho) and John Sherman Cooper (R-Ky) would limit the President's con- stitutional powers as commander-in-chief to "protect the lives of United States armed forces in South Vietnam." The Cooper=Church amendment - which still appears at least a week away from a final vote-would bar retention of U.S. troops in Cambodia after July 1, restrict use of U.S. air power in that country and prohibit financing of foreign advisers. While some backers of the Byrd amendment argued Cooper-Church had been weakened, other supporters said it had not. "I do not regard this language as hav- ing any substantive effect on Cooper- Church," declared Sen. J. W. Fulbright, (D-Ark) chairman of the Foreign Rela- tions Committee. But Fulbright, one of the five who voted against the, amendment, said he did so for fear that people would misinterpret an affirmative vote as a change of heart in his vigorous opposition to the Cam- bodian invasion. "Some senators assert this language is meaningless," said Byrd during the de- sultory debate. "Well, it isn't meaningless. Anybody who says it is, hasn't read it and thought about it." Arguing for his amendment, which was backed by administration leaders in the Senate, Byrd said it was not intended to relieve "the President of what is a very clear responsibility of his, in my judg- ment, to consult with the Congress and to get its approval and its support before entering into any new war or any new commitment." Byrd sponsored, with administration backing, an amendment that was defeat- ed last Thursday 52-47 which also de- clared nothing in Church-Cooper re- stricted the President from protecting U.S. forces in Vietnam. That far more sweeping amendment, however, would have pertained to all sec- tions of the Cooper-Church amendment. Opponents said it would have amounted to a restatement of the controversial Tonkin Gulf resolution of 1964 which former President Lyndon B. Johnson used as authority for the first major es- calation of the war. With the second Byrd amendment out of the way, Sen. Robert J. Dole (R-Kan), called up an amendment that would re- peal the Tonkin Gulf resolution. s u b m i t a recommendation to council within a specified time limit. Under current procedure, council has veto power over any action taken by the policy board but may not initiate any action on its own. Actions taken by the board are considered final unless rejected by a two-thirds vote by the council. The new ordinance would also make the director of Model Cities program di- rectly responsible to the council and mayor. The present 15 'member policy board would be expanded to 23 and would also add two concilmen and three representa- tives from city departments in a non- voting capacity on the board. The present method of selection of board members-as representatives of community groups such as the NAACP and block clubs-will be replaced by direct election of members from the neighborhood, Reading a prepared statement, Mayor Robert Harris claimed that Dr. Wheeler was reconciled to the position that the changes should be made in order to meet federal guidelines concerning city respon- sibility for local Model Cities projects. After the ordinance passed, however, Wheeler said that "the mayor misrepre- sented my views in claiming that I was reconciled to such changes." Ezra Rowry, acting chairman of the Model Cities policy board, said that the mayor was "lying" in his statements claiming that the changes were required to meet federal guidelines sent by the Washington and Chicago Model Cities offices. Rowry said that the guidelines stipu- lated only that there be direct lines of authority between the program director, the mayor and City Council and did not require that the director could not also be responsible to the policy board. Rowry also claimed that the mayor had lied in stating that the proposed changes had been approved by the executive com- mittee of the policy board. At the June 9 session of City Council, Harris said that the proposed changes appeared to be a satisfactory compromise between the desires of federal officials and the desires of the majority of the board's executive committee.
