UNIVERSITY 761-0700 Open daytime beginning June 22nd Requ WASHINGTON (P)--The Su- preme Court yesterday exempt- ed from militaryx, service all young men who oppose war on strong ethical or moral grounds --even if this opposition is not based on religious belief. The draft law, said Justice Hugo L. Black, provides exemp- tions for "all those who con- sciences, spurred by deeply held, moral, ethical, or religious be- liefs, 'would give them no rest or -peach if they allowed them- selves to become a part of an instrument of war." The 5-3 ruling interpreted the conscientious objector classifi- cation in the .draft law and put under its protective cover youths who oppose war for ethical rea- sons-so, long as they adhere to_ iremen their beliefs with the fervor with which a religious objector believes in God. Chief Justice Warren E. Bur- ger and Justices Potter Stewart and Byron R. White dissented. The ruling reversed the convic- tion of Alliott Ashton Welsh II, a Los Angeles computer engi- neer who refused Army induc- . tion in 1967. A Selective Service spokes- man said the agency would have no comment pending examina- tion of the court ruling. Welsh, whose three-year pris- on sentence was upset, did not base his opposition on religious training. He stated he believed "the taking of life--anyone's life -to be morally wrong." In a second draft case, the its for court ruled 8 -to 0 that local boards must reconsider the IA classifications of men who make new and serious claims for exemption before they are in- ducted.: A "courtesy interview" will not do, Justice Stewart said, when a registrant's claim is nei- ther frivolous nor refuted by other reliable informatton in his file. The decision reversed the con- viction of Joseph Thomas Mul- loy, 'a 26-year-old antipoverty worker from Prestonsburg, Ky., who refused Army induction after he was denied a CO clas- sification. In a third ruling, the court held 8-0 that states may not co0 i deny the vote to persons living on federal installations. The federal workers cannot be excluded, said Justice Mar- shall, since they pay state in- come, gasoline, sales and use taxes, are subject to state courts and state criminal laws and therefore, have a stake in policy decisions by the state. Black, speaking for the ma- jority in the Welsh case, said the conscientious objector ex- emption is not designed only for individuals who oppose war "from traditional religious con- victions." But it also is not designed, he said, for men who are motivated by expediency or pragmatism. The key test, the justice said, is 4 ' p ,i i D. rFuresi Near Hill Street Modern 2 Bdrm., 3-man FURN. - FALL 668-6906 43Ctc 2-BEDROOM furnished, quiet, close to campus, parking. Mgr. 101-202.
