indictment, which had charged
Hilliard with threatening the
President's life in a speech at an
antiwar rally in Golden Gate
Park Nov. 15, 1969.
Hilliard 27. had been free on
$30,000 bail. The trial had been
expected to begin today.
The judge also said that if ap-
peals in similar cases should be
decided differently by the U.S.
Supreme Court, the dismissal
could be withdrawn and the in-
dictment reinstated.
He referred to a ruling by the
6th Circuit Court of Appeals that
the government would have to
disclose wiretap contents In-
volving White Panthers in De-
troit. The government has ap-
pealed this ruling to the Supreme
Court.
Hilliard's speech at the rally
was filmed and recorded on the
television. He said: "We will kill
Richard Nixon; we will kill any
obscenity that stands in the way
our our freedom."
