JOHN MITCHELL said yesterday, there will be no federal grand jury investigation into the killings of four students at Kent State University by the Ohio National Guard last year, While agreeing that the deaths were "unnecessary, unwar- rented and inexcusable," Mitchell said he felt there was "no credible evidence of a conspiracy between the the National Guardsmen", and "no likelihood of successful prosecution of individual guardsmen." President Robert White of Kent State said yesterday the school "must and does accept" the attorney general's decision. Former student body president Craig Morgan however said he "morally abhorred" Mitchell's decision. NORTH VIETNAMESE gunners made heavy shelling at- tacks yesterday afternoon and evening for the second successive day on a string of seven South Vietnamese positions along the DMZ. Preliminary field reports put South Vietnam's casualties in the attacks at one killed and eight wounded. Lt. Col Hien, spokesman for the South Vietnamese command, said that the shellings may be an attempt by the North Viet- namese to find a weak point to choose as their objective for a major ground attack. THE INTERSTATE COMMERCE COMMISSION (ICC) is being used by the railroad and trucking interests to evade the federal securities law, according to a study by a subcommittee of the House Commerce Committee, The study says "the ICC in its present posture is incapable of protecting the interests of public investors", due to a division of responsibility between the ICC and the Securities and Ex- change Commission. The subcommittee report recommends revision of the secur- ities laws to strip the ICC of any jurisdiction over the securities of rail and motor carriers. THE ENVIRONMENTAL PROTECTION AGENCY (EPA) pub- lished yesterday its final regulations for states to follow in de- veloping plans to clean up air pollution by mid-1973. As printed in the Federal Register, the regulations require states to have an emissions-control strategy, along with schedules and time- tables for reducing emissions from sources of air pollution. States have until January 3, 1972 to submit their plans for air pollution control. If the plan is unsatisfactory, law requires the EPA! to provide its own substitutes. Despite the action, consumer advocate Ralph Nader remained critical, calling the FDA procedures "an outrage." The FDA, he said, had knowledge of possible contamination at least 10 days before they took action. In further action yesterday the FDA announced it is seizing 1.3 million cans of food packaged by the Bon Vivant company due to the failure of the company to recall the food fast enough.
