During an extensive question and answer period, Kufistler covered a variety of aspects of legal work involved in defend- ing dissenters. Detroit's grand jury investi- gation, which has recently be- come a subject of debate with the development of the case of Ken Kelley, was also a major area of concern for Kunstler. He labeled grand juries "per- secuting offices," saying they have never before been used "in the sense they are now being used." He attacked grand jury prac- tices of secrecy, denial of t h e right to legal counsel, and es- pecially the use of "immuni- ties." Immunities, he explained, al- low the jury to force anyone to testify under a promise that nothing he says can be u s e d directly against him. Kunstler said friends an d parents of people facing inves- tigation have been called be- fore these juries to testify, term- ing this "reminiscent of Nazi Germany." He also denounced the spread- ing uso of police infiltrators, and accused them of often b e i n g involved with "creating the crime" they are supposed to be investigating. Answering a questioner wh o asserted that his courtroom vic- tories were proof the system works, Kunstler charged t h a t "the system created these trials." He warned, however, if the system doesn't respond to re- form it will have to be over- thrown. He characterized the country as being in a "pre-revolution- ary stage" saying from this point violent revolution will take place if change isn't made in other ways. Kunstler has become famous in recent years as a defense attor- ney for leaders in the radical movement, including Sinclair. Although known for several years for his work in the civil rights field, he first reached na- tional prominence when he acted as chief defense counsel at the "Chicago 7" conspiracy trial.
