Basketball Association asked a federal court yesterday to - hold a contract the team holds with Elvin Hayes, a star per- former acquired in a recent trade with the Houston Rockets. The petition also seeks an in- junction that would prevent. Hayes from playing or negotiat- ing with any other professional team until the contract expires. Hayes was acquired from Houston last month in exchange for Jack Marin and a 1974 draft choice. The former University of Houston star became a Roc- ket when Houston interests pur- chased the San Diego franchise last year. The Court petition says Hayes is seeking more money while alleging a 10-year, $1.07 million contract originally negotiated with San Diego was based on "fraud and undue influence." The contract also calls for an annual bonus up to $15,000 bas- ed on the team's performance.
