At the same time, he said, the law serves to bar con- tempt judgments until the wire- tapper shows he acted legally. The four Nixon administra- tion nominees, Burger and Jus- tices Harry Blackmun, Lewis Powell Jr., and William Rehn- quist were united in the dis- sent. Speaking for them, Rehn- quist accused the majority of utter disregard for Congress' in- tent and of bringing about a critical change in the operations of grand juries. The decisions came on the next-to-last session before sum- mer recess begins on Thursday. Among the key cases still to be decided are three testing the constitutionality of the death penalty. A cursory check at McGovern's national headquarters in Wash- ington reveals no record of Brown having ever been regis- tered as a member of the na- tional staff. Brown says he worked in the Ohio campaign as an "organizer" and was then assigned to the Livonia office during the-primary here. Although there seems to be no controversy concerning his ac- tivities, major questions remain whether his essentially volunteer work qualifies him as a national staffer. One person who doesn't think so is Laird Harris, the political director of McGovern's state of- fice here. "I was in charge of the field operation in the Michigan cam- paign," Harris says. "I cleared all national people in the state and he (Brown) was not cleared by me. Brown defends his use of the term "national staff" in cam- paign literature. "In my opin- ion, 'he says, "I was national staff. I was told in Ohio that that was what I was called." Fenton says no count of peti- tion signatures has been made yet, but he expects that by July 5, MMI will have about 100,000. If MMI does not collect enough signatures to put the question on the November bal- lot, Fenton says they will con- tinue petitioning for the next state election in two years. "We'd like to make it this year," he says, "but we're com- mitted to legalizing marijuana no matter 'how long it takes." Fenton cites a lack of com- munity participation as one reason the two-month initiative has not succeeded thus far. "People haven't been working on it enough," Fenton complains. "They relate to it, but not enough are involved."
