Billy Cunningham, the 76ers' all-league forward has re- portedly agreed to terms with the Carolina Coug- ars of the American Basketball Association fol- lowing a court order that he join the Carolina team, Earlier in the day Philadelphia announced the appointment of Ray Rubin as the 76ers' new coach. Rubin, 45, who says he's used to starting at the bottom, rebuilt Long Island University's basketball program after the 1951 college basket- ball gambling scandals, and later became the uni- versity's athletic director. In 11-years as basket- ball coach at LIU, Rubin had only one losing sea- son. 76ers general manager Don DeJardin handed Rubin a team which won 30 and lost 52 last season and finished a poor next-to-last in the Atlantic Division of the NBA. Cunningham, a 29-year-old New Yorker who starred for the University of North Carolina, has played seven seasons with the National Basket- ball Association Philadelphia 76ers, averaging 21.3 points per game. The 6-foot-7 Cunningham was to be introduced at both meetings. Beforehand he said, "I've never had anything against playing with the Cougars. I'm impressed that their people are the type who will build a successful organization. I'm just glad it's all over. I love the game of basketball and I'm anxious to play here." Cunningham, while still with Philadelphia, was signed to a three-year Cougar contract in August, 1969. It was to start with the 1971-72 season. But in April 1970, he signed a new three-year pact with the 76ers, claiming that. Carolina had reneged on $80,000 of a $125,000 bonus due that month. He said he no longer felt himself bound to the ABA team. Last fall an effort by Carolina to obtain an in- junction preventing Cunningham from playing for the 76ers was denied by U.S. Middle District Court Judge Edwin Stanley. But in April of this year; the 4th U.S. Circuit Court of Appeals in Richmond, Va., ordered that Cunningham be barred from playing for any pro- fessional team except Carolina until October of 1974, the expiration date of his Carolina contract. "I know Philadelphia has problems," Rubin said. "Cunningham is a tough loss. Whatever Cun- ningham did, five-to-eight other guys are going to have to make up, split his statistics among- them, err...
