Tom Railsback (R-Ill.) and William Cohen (R-Maine) said Wiggins was not speaking for them and that they had not made up their minds. Railsback said he thought there were at least four Nepub- licans "who are waiting to see what the legal theories are." Ile said the four are Cohen, Reps. Caldwell Butler (R-Va.), Hamilton Fish (R-N.Y.) and himself. MEANWHIIE, the committee released a volume of documents dealing with alleged efforts by the administration to have the Internal Revenue Service harass President Nixon's enemies or protect his friends. According to the documents, the IRS was under utmost con- stant pressre from the White House and knuckled nder oc- casionally to White Ihouse de- mands. Rodino's announcement on the proposed articles of in peachment brought immediate protests from the Republican minority that thie staff plans to offer only ar:uents supporting the impeachment of President Nixon rather than any of the case against impeachment. THE FINAL step before con- sideration of articles of im- peachment begins is the presen- tation of an oral summation and legal brief by James St. Clair, the President's impeachment defense lawyer. It was elear from interviews with committee members and staff sources that the proposed articles of the impeachment would reject the White House argument that the Constitution requires criminal conduct as the grounds for removal of a presi- dent from office, The proposed articles the staff plans to offer tomorrow are expected to be broad-based allegations focusing on the Watergate cover-up, attempted misuse of government agencies, violations of political contribul- tion laws, domestic surveillance activities and the President's income tax problems. IN EACH case it would be alleged that the President was a willing and knowledgeable participant in tse activities, if not from their insception, at least from the time he learned of them from his staff. St. Clair has based his de- fense on the lack of evidence directli linking Nixon to a crim- inal act such as ordering pus ment of hush imoney to the original Watergate defendants.
