HEW THREATENED last winter to
withhold some $90 million in federal
funds from North Carolina's state
universities, and began laying down
deadlines for the state to reorganize its
system of colleges and universities.
The agency claimed the state's
higher educational system encouraged
segregation because in many cases the
system had separate programs on dif-
ferent campuses-one program for
blacks and one for whites. HEW
demanded as a condition for continuing
federal aid that the state eliminate the
duplicated programs.
Even though North Carolina Gover-
nor Hunt offered to upgrade the state's
black colleges and universities with $40
million in state funding, HEW refused,

pressing its demand for elimination of
programs.
IN APRIL, University of North
Carolina attorneys obtained a court in-
junction that kept federal money
flowing. The case is still before a U.S.
district judge in Raleigh.
Califano's resignation will have no ef-
fect on HEW's demand for
reorganization of the university system
in North Carolina, according to William
Friday, president of the University of
North Carolina's Board of Governors.
Because the case is in court, "That
removes the role that an individual can
play," Friday said Thursday.
But Friday agreed that North
Carolinians identified Califano as the
source of the university's problems with
HEW.
NORTH CAROLINA is a test case for
HEW, which wants to force other states

in the south to reorganize their higher
education systems, Friday said, so it
was of special interest to the agency.
Friday said the creation of a new
federal Department of Education could
help the university, if the civil rights of-
fice of HEW were transferred to the
new department. Califano opposed the
creation of a new education depar-
tment, and it was a sore point between
Califano and Carter. Carter proposed
the new department.
The tobacco industry, too, had con-
flicts with Califano, who many say
waged a personal crusade against
smoking after he himself kicked the
habit..
CALIFANO TRIED to have smoking
banned in all public buildings and on
airplanes, and tried to have the war-
ning on the side of cigarette packages
strengthened.

After the secretary's resignation was
announced, North Carolina Agriculture
Secretary James Graham said, "I think
this is a good move for the Carter ad-
ministration as far as North Carolina is
concerned, and will be a relief to the
tobacco industry. I am quite naturally
thankful and pleased. We expect
Patricia Harris (Califano's
replacement) to be more rational and
understanding as head of this impor-
tant office under President Carter's
reorganization."
Sam Currin, legislative assistant to
U.S. Sen. Jesse Helms (R-N.C.) also
expressed relief ass Califano's resign-
tion, and he said he thought his remarks
"pretty much represented the feelings
of Senator Helms and the entire North
Carolina delegation."
BUT CURRIN was not sure whether
Califano's resignation would help Car-
ter in North Carolina. "It could, but so
much damage has already been done,"
Currin said.
