Bob Graham signed the fifth death warrant of his administration yesterday, or- dering convicted murderer Howard Virgil Lee Douglas to die in Florida's electric chair next week. Execution wasset for7a.m. July 26.' John Spenkelink, the first prisoner put to death in the United States in more than 12 years against his will, died in the same electric chair May 25. The other three Graham has ordered executed all have won stays. Douglas immediately requested a stay from a Polk County circuit judge, but was denied. His attorney argued the state Supreme Court had considered Douglas' past convictions in upholding his sentence, and that Douglas' court- appointed counsel had alcohol on his breath during the trial. DOUGLAS' ATTORNEYS said they intended to file a petition for a stay with the state Supreme Court, probably today. Douglas' death warrant expires at noon Friday, July 17, giving defense at- torneys just 11 days in which to win a stay. A hearing for a stay for Douglas was scheduled later yesterday in Bartow. His death warrant expires at noon on Friday, July 27, giving defense attor- neys 11 days to seek a stay in the federal courts. Douglas, 43, was sentenced to death for the July 17, 1973 slaying of Jessie Atkins Jr., near Bowling Green.
