Ac- cording to police the woman was on N. Main St. at 7:30 p.m. returning home from a local tavern when a car drove up beside her. She recognized the driver as someone she had seen in the bar earlier in the evening. The woman told police that the driver forced her into the vehicle, then drove to Fourth Avenue and Ann Street where he demanded she perform a sex act upon him. Guess you just had more friends than the rest, huh Dick? WASHINGTON (AP) - States may distinguish between day and night stu- dents in determining who is eligible for unemployment compensation,. the Su- preme Court ruled yesterday. The justices, acting without hearing arguments, reversed a decision by the Idaho Supreme Court that such distinc- tions are unconstitutional. THE IDAHO Department of Employ- ment had appealed, contending that the state court was wrong when it ruled that such distinguishing violated consti- tutional rights of equal protection. "In a world of limited resources, a state may legitimately extend unem- ployment potential by not restricting their availability during the day by at- tending school," the court said in an un- signed opinion. Justices John Paul Stevens, William Brennan Jr. and Thurgood Marshall dissented on certain procedural groun- ds but did not voice disagreement with the decision's main trust. THE DECISION is a setback 'for Marlene Smith, a part;time college student whose weekly unemployment benefit checks were cut off in 1975 when she enrolled for morning classes at Boise State University. Idaho law states that no person can be ruled unemployed while attending a regular school; "excluding night school." Smith successfully argued before the state's Industrial Commis- sion and the Iadho Supreme Court that day students should not be treated dif- ferently from night students. Smith said her 7 to 9 a.m. daily classes would not interfere with her eligibility for a job, such as department store clerk, which would begin after 9 a.m. each day. She had worked as a retail clerk in Boise and held a clerical job in Garden City, Idaho, before losing her employ- ment. In appealing to the Supreme Court, Idaho Attorney General Wayne Kidwell argued that the state legislature had the right to determine free from judicial interference that night students carry closer ties to the labor force than do day students.
