LIBERTY M63-6771 It. all adds up HOUSTON (AP) - A Mexican- American leader said yesterday it would be "very disruptive, very divisive" if a federal judge rejects a Justice Department motion to stiffen the sentences he gave three ex- policemen in the death of a Mexican- American prisoner. The .motion filed Wednesday with U.S. District Court Judge Ross Sterling said the probated sentences he assessed March 28 on civil rights violations were illegal because conviction carries a maximum penalty of life imprison- ment. There was no comment from Sterling and no date was set for him to hear the motion. LAWYERS FOR THE defendants said they would fight the motion, and there were indications any ruling by Sterling would be appealed to the U.S. Fifth Circuit Court. "If the judge denies the motion, he is essentially admitting violating a federal law, but stating he is not going to correct the illegal actions," said Ruben Bonilla, a Corpus Christi lawyer who is state director of the League of United Latin American Citizens. Bonilla said such a position would "reinforce the sentiment in the Mexican-American community that he is a discompassionate fellow and that he has no interest in protecting the rights and privileges of Mexican- Americans." The former policemen - Terry Den- son, 27, Stephen Orlando, 22, and Joseph Janish, 24 - were convicted Feb. 8 by a federal court jury. Sterling sentenced them to one year in prison on a misdemeanor count -for beating Torres and gave them 10-year suspen- ded sentences probated for five years on a felony count of conspiring to violate Torres' rights with resulting death. The sentences prompted immediate controversy, as had the suspended sen- tences Denson and Orlando received last year when they were convicted in state court on misdemeanor negligent homicide charges. WEDNESDAY'S motion did not challenge the one-year prison sentences but said the probated sentences were "illegal and not within the scope of the court's discretion." Bonilla said Sterling should set a new sentencing date and assess a punish- ment in keeping with the case of Richard Morales, another prisoner who died in police custody. Frank Hayes, former Castroville police chief, received a life sentence in San Antonio federal court in February in the Morales case, after receiving a 10-year sentence in a state court trial. Bob Bennett, lawyer for Denson, said the motion cited no similar case in which a probated sentence has been ruled illegal. He said he believes federal law excludes probation only when death or life are the only possible sentences. "The judge correctly interpreted the law and we will file the appropriate response to the motion," he said, "I think the judge was aware of the gover- nment's position at the time of senten- cing and had decided probation was ap- propriate."
