'NEW DELHI, India (AP) - Risk-

ister Indira Gandhi defied the new
Indian government's probe of her
fallen regime and walked out of a
hearing yesterday.
The 60-year-old defeated leader left

ruled that her refusal was a punish-
able offense under the Indian penal
code. He ordered the commission
secretary to file a complaint before a
Delhi magistrate.
'The developments were a dramatic
new stage in the confrontation be-
tween Gandhi and the administration
of Prime Minister Morarji Desai. His
Janata people's party routed the
Gandhi forces in the March 1977
national election.
There had been speculation Gandhi
would take her quarrel with the
government-appointed Shah com-
mission to India's supreme' court.
But her chief lawyer, Frank An-
thony, denied this after yesterday's
hearing.
"WE KNOW THE consequences
and we will'fight it out," Anthony told
reporters.
'Justice Shah said Gandhi had
committed a penal code violation
punishable by up to six months in jail
or a fine up to $80, or both.
Gandhi spent one night in custody
after her arrest in a corruption case
last October. She was released on a
magistrate's ruling of insufficient
evidence.
- The October episode stirred a
temporary wave of sympathy for
gandhi and the Desai government
was believed reluctant to risk this
again.
-BUT GANDHI told reporters after
leaving yesterday's hearing session
that the authorities are determined
to arrest her.

heavily guarded headquarters of the
Shah commission by her son, Sanjay,
and other family members. Police
used bamboo clubs to disperse some
slogan-chanting pro-Gandhi demon-
strators who tried to break through
their cordons.
-;The Shah commission hearings
that began last September have
sketched a picture of authoritarian
acts by Gandhi's government, includ-
ing the use of arrest, or threat of
arrest for political ends and pressure
and manipulation of the news media
to glorify her rule.
The commission, which reports to
the president of India, wanted to
question Gandhi on 11 issues of
specific violation of laws and govern-
ment regulations cited by earlier wit-
nesses. The most important dealt
with the circumstances in which the
Gandhi government proclaimed the
June 1975, national emergency and
jailed thousands of critics.
