Quad RM 124 i I WASHINGTON UP) - The Su- preme Court ruled unanimously yesterday that defendants have the right to ask jurors whether they are racially prejudiced. However, the court refused to extend that right to questions about other forms of prejudice. The ruling reversed the drug conviction of a South Carolina civil rights leader, Gene Ham, who was convicted of possessing marijuana and sentenced to 18 months in jail. Ham contended his rights were violated because the trial judge re- fused to ask the jurors if they were prejudiced against Negroes and whether they were prejudiced against people who wore beards. The Supreme Court, in an opin- ion written by Justice William Rehnquist, said the Constitution gave the defendant the right to ask The Michigan Daily, edited and man- aged by students at the University of Michigan. But the high court said the Constitution did not give defend- ants the right to ask if the jurors were prejudiced against beards. Justices Thurgood Marshall and William Douglas dissented from the second ruling. Douglas said it was an abuse of discretion for the trial judge to refuse questions "by which prospective jurors preju- diced to hair growth could have been explored." "Nothing is more indicative of the importance currently being at- tached to hair growth by the gen- eral populace than the barrage of cases reaching the courts evidenc- ing the attempt by one segment of society officially to control the plumage of another," Douglas said.
