In other words, almost every de- fendant has been heard during liti- gation by C&R members not in his college. C&R consequently was stripped of its judicial duties. With the num- ber of litigations that usually arise during an SGC election, litigation has formed the bulk of C&R's duties. C&R may still, however, certify the election and perform adminis- trative duties. CSJ Chairman Ron IIearv called the case a "pretty clear" consti- tutional violation. He said C&R has a number of options, suggesting that they per- form only as an administrative' body; form two bodies within C&R, one administrative and the other judicial; or appoint a separate judicial body altogether. Henry claims, the hearing was essentially a more forceful continu- ation of a hearing during the last election, which was only advisory. At that time, Henry agreed that C&R was "too political to be an effective judicial body." The confusing C&R situation was not corrected this election, said Henry. "We had to order them to straighten it out now." SGC has yet to act on the CSJy ruling. If they decide to make C&R merely an administrative body, however, the unending elec-7 tion litigations will fall entirely on the shoulders 'of the appellate judi-; cial body, CSJ. He said the state is ex- torting the $200,000 in bond by hold- ing Plamondon and Blazier "at' gunpoint"-in jail. Mazey called the bond ruling an illegal use of preventive detention, since, he claimed, there is no rea- son to expect the two defendants would commit violent crime if they were released on bail. "I doubt the. prosecution serious- ly contends that they will win this case," Mazey said. "If they are to get their pound of flesh it has to be before the trial takes place or they'll get none at all." Davis claimed State Attorney General Frank Kelley has taken jurisdiction in the case fearing that "the political force of the Rainbow ; People's Party is h danger to the, people of Michigan." However, John Wilson, the assist- ant attorney general in charge of the case, said the attorney gen- eral's office entered the case be- cause Benzie County, where the trial will take place, has no full- time prosecutor. Wilson would not comment when asked why such a high bond had been sought for Plamondon and Blazier. Norris Cotton (R-N.H.) spoke out the same day the top Democrat and Republican on a congressional subcommittee asked Nixon to per- mit Dean to testify under strict ground rules at hearings on execu- tive privilege. Tower, who is chair- man of the Senate Gop Policy Com- mittee, told newsmen "It's in the best interest of the White House that the whole thing be barred and cleaned up."
