The advertisements appearing in The Daily, for exampe, pro- vide only the name of the serv- ice and a phone number. One agencyhclaims in their ad there is no charge for its abor- tion referrals. This same agency, which charges $225 for the abortion, asks for a $25 deposit to be sent to them and the additional $200 to be paid directly to the hos- pital. A major criticism of the agen- cies is directed at the actual re- ferral fee as well as at the al- legedly false advertising. "We are concerned that women are paying these fees when they can get the same service through the University at no cost," says one University woman. The amount of the fees charged by commercial agencies and the fact the fees are not widely pub- licized and readily disclosed are principle concerns of Mindell and the others investigating the re- ferral services. "The referral agencies," Min- dell says, "don't disclose their referral fee which can be as high as 25 per cent of the package price, and sometimes is higher than the fee the doctor gets for actual abortion." Mindell adds that the fees 'ange from $25 to over $150 for a referral. . Most agencies surveyed by The Daily collect the fee by requiring that a deposit be sent before they will make an appointment. Once the agency receives the deposit the final arrangements are made. The balance of the cost is then paid to the hospital or clinic. Some doctors charge that be- cause the referral is based pri- marily on a woman's' physical condition and only partly on her financial situation, a telephone referral made by a layman might be practicing of medicine without a license. "I don't think ideally even a doctor can decide over the phone what type of abortion operation a woman should have," says Dr. Robert Hall, associate professor of gynecology and obstetrics at Columbia University's medical school. The Daily survey reveals that, generally, when a woman calls one of the agencies she is im- mediately asked how niany weeks pregnant she is. The phone operator uses this information to determine the method of abortion to be used, and whether the wo- man will have to spend time in a hospital. One agency also offers the choice of a general or local anes- thetic and said this would dleter- mine whether an overnight stay in a hospital would be required. The explanation given by this agency as a guide to choosing one method or the other was, "If you are a baby about pain you should probably choose a general anesthetic." An additional question under in- vestigation is whether the doc- tors and hospitals return part of the abortion fee to the referral service. Should this be true these agen- cies would then be aiding doc- tors in participating in an illegal practice called fee splitting. Many of the referral agencies, however, view themselves as community services. "We are a private organization providing a necessary service to women," comments the execu- tive director of one agency. "We've done nothing wrong." She says her agency has referred 22,000 women since July. Although she would not give a definite price for either the abor- tion or the agency's fee, she says the charge varies depending on the particular case and the medi- cal services required. "We have women pay the en- tire fee to us and then we pay the hospital," t h e spokeswoman adds. She also says she does" not un- derstand the charge that the ag- encies are practicing 'medicine without a license. "We don't practise medicine," she claims. "We don't prescribe any medication and we don't ask medical information." Lefkowitz's recommendations, to either regulate or outlaw these agencies will concern future poll- cies toward regulation of the services, or establishment of ef- fective alternative means of pro- viding this much-needed service to out-of-state women. The non-profit organizations providing free referral claim to be presently overworked. Family Planning reports that its 12 per- sOil abortion counseling staff handles over 6,000 calls a month. One possible solution, proposed by the Abortion Rights Associa- tion of New York, calls for the establishment of a referral serv- ice under the auspices of the New York State Department of Health. All doctors and abortion facili- ties willing to perform abortions at reasonable prices, spokesmen say, would enroll with this serv- ice. Mindell declines to comment on specific alternatives until Lefkowitz publicly announces his decisions. He did say, however, that Lef- kowitz will propose ^oncrete mea- sures to implement his recom- mendations.
