The city, however, would like to take it down, charging that it is violating its new sign control or- dinance. Ashworth and Sun Oil Company have gone to court to keep the sign standing. Ashworth and Sun Oil began seeking permission from the city -to erect the sign ir truly, and were directed to the Zoning Board of Appeals. They appeared before this board in early September and were issued a permit to erect the sign 16 ft. from the road. By a new city law, a sign the size of the SUNOCO sign should be 87 feet back from the road. During August, however, the city had passed a new sign control or- dinance, creating a Sign Board of Appeals, which under the new law should have considered the case. Work was being done on the sign in early December when the city discovered that the wrong board had approved the sign, and sent notice revoking the perrmit and calling for construction to stop. The sign, however, was com- pleted. The city then informed the star tion that it should take down the sign or it would be removed at the station's expense. However, shortly before the city began to remove the sign, the company obtained a restraining order to leave the sign standing pending consideration in court. The pre-trial has been set for April 20.
