CRC Powers The only thing the Legislature could do with the CRC is make recommendations, he said. He con- cluded that the section of the constitution creating the CRC has quite broad terminology." Thayer noted, however, that the Kelley ruling over the local civil rights' groups may not hold up in court. "It may be challenged right here in Ann Arbor," he said. A Thayer commented that two things are at stake in the local ruling: "Is housing a civil right?" and does police power of the new constitution allow local units to have the same power? No Legislation He noted that the Legislature is not now planning any legisla- tion to clarify this during the spe- cial session. The real test of its constitutionality will come through the courts after the new constitu- tion is effective. Thayer said that the governor is now acting on the assumption that the CRC will have broad power over all local units. Kelley based his ruling on the fact that the constitution provides for a CRC and, whether or not the state has one, it is the state's power and authority to administer it. He noted that in 1936 there was a statewide provision to have a minimum wage law, although there was no such law passed at that time. When the City of De- troit passed a minimum wage law of its own, the state courts ruled this law unconstitutional. On this basis, Kelley felt that the present CRC provision pre- empts all local civil rights' groups and fair employment practice commissions. Thayer noted also that the pres- ent FEPC must be eliminated, and that this is really the major is- sue of the CRC in the present ses- sion. If it is not "pre-empted by January 1, there is serious ques- tion" of the transwer of functions and present funds from the FEPC. No Action Yet Attorney John Fiekens, who is the head of the new commission, said that the people proposed to comprise the CRC next year have met six times, but that the first action to be taken by the com- mission as a group will not come until after January 1, or when the members are sworn in. He said, however, that the mem- bers are formulating organization frules, budget requirements and a working staff now. Fiekens said that the commis- sion is made up of eight men who represent a cross section of the state. Included in this group is a Catholic priest, a Jewish Detroiter, a Negro minister, and a Detroit businessman. Fiekens also noted that, since the commission is the first ever created under a Michigan consti- tution, it will have much added powers over that of the FEPC. He said that the commission would have powers in the fields of housing, employment, education, and public accommodations where the FEPC was authorized to act only on employment. The new constitution states that the commission is to be comprised of "eight members, not more than four of whom shall be members of the same political party."
