THE MICHIGAN DAILY Committee on Referral Replies to SGC Action (EDITOR'S NOTE: Following are excerpts from yesterday's statement by Student Government Council's Committee on Referral which lists several objections to SGC's proposal on structuring its authority over membership in student organiza- tions. The committee serves in an advisory capacity for Vice-President for Student Affairs James A. Lewis, who is empowered to veto SGC ac- tions.) The Committee on Referral held meetings on Oct. 16, 21 and 22 to consider the various objections advanced against adoption of the Membership Regulations Plan as presently drawn and the answer- ing arguments thereto. It submits as its conclusions the following statement, which should, in its opinion, be weighed by Stu- dent Government Council in re- viewing its action of Oct. 2 with regard to the plan: Legality , With regard to the objections of a legal and constitutional nature, the committee does not feel that they should be controlling over SGC's action in this matter. Wil- liam Lemmer, attorney for the University, has presented a legal opinion to the vice-president for student affairs which refutes the contentions. The committee has reviewed that opinion. The Committee on Referral has also been made aware that legal advice was sought and obtained by SGC from mem- bers of the Law School faculty during preparation of the draft of the Regulations. It understands that Council was assured that the Membership Reg- ulation Plan, as drafted, meets all legal and constitutional require- ments. The committee feels that the legal issues raised are beyond its competence to assume to re- solve. Tribunal The Committee on Referral is of the opinion, however, that the Ian- guage of Section 22 of the Mem- bership Regulations Plan is of questionable validity under the teris of the SGC Plan adopted by the Regents in 1959. The Student Government Plan, which is the "charter" under which Council must operate, describes the au- thority of SGC as follows: To serve as an appointing body for the selection of student committees, and student repre- sentatives to University commit- tees and to establish such stu- dent boards and committees and to adopt such operating pro- cedures as may be necessary to carry out the functions of stu- dent government as herein de- scribed (emphasis added). The language of the proposed Section 22, it is true, does not say explicitly that the third member of the Membership Tribunal shall be someone other than a student (i.e., a faculty member, an administra- tive officer, or an alumnus) ; but the Committee on Referral has been led to believe that this was the purpose in using the term "member of the University" to identify the category of persons who may be appointed to the Membership Tribunal. Student Only The specifications that "at least two" of its members shall be se- lected from the student body lends substance to this interpretation. DIAL 5-6290 ENDS TONIGHT WALT DI NEY'S The Committee on Referral is of the opinion that the provisions of the SGC Plan quoted above limits Council to selecting "students" as members of student committees; to selecting "students" as members of University Committees; and to "establishing" only" student boards and committees," i.e., boards and committees made up of students only. It has no authority under the SGC Plan, in the opinion of the Committee on Referral, to create a "University Committee" which the Membership Tribunal would be if it had a non-student member. We do not understand how a faculty member or a University administrative official, by accept- ing appointment at the hands of SGC, can shed his faculty or Uni- versity administrative status and to all intents and purposes con- vert himself into a student.
